DRAFT
existing onsite in the footprint area to determine the location of existing structures,
underground utilities and services. Pegasus MH Ventures I should be aware that
penetrating the site's surface is inherently risky. It is impossible to determine with
certainty the precise location of all structures which may be buried in the ground.
Kleinfelder's fee is not adequate to compensate for both the performance of the
services and the assumption of risk of damage to such structures. Disruption of
utilities or damage to underground structures will be the responsibility of Pegasus
MH Ventures I or those responsible for identifying the pipeline locations (Chevron or
PG&E). Services rendered by Kleinfelder to repair them will be billed at cost.
Underground Service Alert (USA) at 1-800-642-2444 provides a partial location
service free of charge for major utility lines. It is important that Pegasus MH
Ventures I understand that subsurface utilities buried under private property will not
be marked by the public utility companies contacted by USA. USA will be
contracted at least 48 hours prior to performing field work.
➢ Kleinfelder is not responsible for safety considerations related to the Chevron and
PG&E Pipeline easement. The selected excavation contractor, Chevron Pipeline
Company and PG&E Pipeline Company will be responsible for safety related to their
pipelines.
➢ Backfill, compaction and compaction testing are not part of the proposed services,
but will be supplied by the selected backfill contractor.
➢ Based on preliminary information provided by RAH Environmental, Kleinfelder
assumes the waste will be profiled as a non RCRA-hazardous waste and acceptable
at Forward Landfill or Altamont Landfill (Class II Landfilsl). Classification other than
non-hazardous or non RCRA-hazardous waste may incur disposal to differing
landfills (Class 1) and will substantially increase disposal costs through profiling,
transportation and disposal costs.
➢ Kleinfelder is not responsible for the site safety of others.
➢ Inclimate weather may impact the schedule and increase costs
➢ Two copies of all documents will be delivered to the client. Additional copies can be
provided for a fee of $50 per copy.
➢ Client meetings and revisions to the reports are not included in the budget estimate,
but can be provided on a time and materials basis at the client's request.
LIMITATIONS
Kleinfelder prepared this workplan in accordance with generally accepted standards of
care which exist in San Joaquin County at this time. It should be recognized that
definition and evaluation of geologic and environmental conditions are a difficult and
inexact science. Judgments leading to conclusions and recommendations are
generally made with incomplete knowledge of the subsurface conditions present. More
extensive studies, including subsurface investigations, may be performed to reduce
44843.T04/ST05R997/DH:ly Page 1 of 14
©2005 Kleinfelder, Inc. August 16,, 2005
