Construction of an individual sewage disposal system(s) under permit and inspection by the EHD is required at the time of development based on the Soil Suitability/Nitrate Loading Study findings. (San Joaquin County Development Title, Section 9-1110.3 &9-1110.4) D. This facility is a considered a transient noncommunity water system as defined in Health and Safety Code, Section 116275(o). The applicant shall submit a Small Public Water System preliminary technical report to the California State Water Resources Control Board, Division of Drinking Water (Water Board), with a copy to the EHD, at least six months before initiating construction of any water related improvement, as defined, and prior to the issuance of building permits (Health and Safety Code, Section 116527). The issuance of a permit to operate a small public water system by the EHD is prohibited without the concurrence of the Water Board. If the Water Board determines that the facility can be permitted as a small public water system, a permit application to operate a Small Public Water System shall be submitted to the EHD for approval prior to sign off of the certificate of final occupancy. (San Joaquin County Development Title, Section 9-1120.2 and 9-1115.9.) An annual permit to operate a public water system is required [Health and Safety Code, Sections 116525 and 116565 (f)]. The supplier must possess adequate financial, managerial, and technical capability to assure delivery of pure, wholesome, and potable drinking water in accordance with San Joaquin County Development Title, Sections 9-1120.2 and 9-1115.9 and C.C.R., Title 22, and Health and Safety Code, Sections 116525 and 116555. The proposed well is shown on the site map to be located within 200 feet of a navigable surface water body,the Mokelumne River.A well located in close proximity to the river has a potential for interconnection and adverse impacts to the river.A minimum 200 foot cement annular well seal is required to offset any potential adverse impacts to the river. Alternatively, an evaluation of the proposed well, including independent well drawdown testing, may be performed and submitted to the EHD for review to determine any potential adverse impacts to the river from the projected groundwater pumping.
