k, <br /> b <br /> CONDITIONS OF APPROVAL <br /> SA-99-18 <br /> Ellis <br /> Site Approval Application No. SA-99-18 was approved by the San Joaquin County Community <br /> Development Department on April 1, 1999. The effective date of approval is April 11, 1999. This <br /> approval will expire on October 10, 2000, which is 18 months from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits <br /> have been secured and remain in force,and(3)all necessary permits from other agencies have been <br /> secured and remain in force. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact:Jeff Fisher,4689653) <br /> a. BUILDING PERMIT: Submitan"APPLICATION-COMMERCIALBUILDING PERMIT." The <br /> Site Plan required as a part of the building permit must be prepared by a registered civil <br /> engineer or licensed architect. This Plan must show drainage,driveway access details <br /> (including gates),on-site parking,landscaping,signs,existing and proposed utility services, <br /> and grading(refer to the"SITE PLAN CHECK LIST'for details). A fee is required for the <br /> Site Plan review. (DevelopmentTitle Section 9-884) <br /> b. ` APPROVED USE: This approval is for acellular communications facility, including a 70- <br /> foot-high monopole tower and a 12-foot by 28-foot equipment shelter as shown on the Plan <br /> submitted February 19, 1999. <br /> A c. SETBACKS: The proposed tower and accompanying equipment sheltershail beset back a <br /> minimum of thirty(30)feet from the front property line, a minimum of ten(10)feet from the <br /> side property lines,and a minimum fifteen(15)feet from the rear propertyline. <br /> (Development Title Table 9-66102) <br />' d. MAINTENENCE: All freestanding structures, antennas, and supporting equipment <br /> associated with wireless telecommunication shall be maintained in good condition by the <br /> provider of the telecommunication facility and, whenever necessary, repaired or replaced. <br /> (Development Title Section,9-1065.7) <br /> e. REMOVAL OF FACILITIES: Freestanding structures,antennas,and supporting equipment <br /> associated with wireless telecommunication shall be removed by the provider of such <br /> facilities and the site restored to its pre-construction state if said facilitieshave not been <br /> operational or used for a period of six(6)consecutive months. Removal and site restoration <br /> shall be completed within ninety(90)days of the end of said six(6)month period. To <br /> guarantee removal of unused or abandoned facilities,the Review Authority may require the <br /> applicant to post a bond or other suitable security instrument.
