Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Mitigated Negative Declaration; and <br /> 2. Approve Revisions of Approved Actions application No. PA-0900094 with the Revised Findings, <br /> Williamson Act Compatibility Principles, and revised Conditions of Approval contained in the <br /> Staff Report. <br /> Revised Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Pian, and any other applicable plan adopted <br /> by the County. <br /> • This finding can be made because Marketing Events, Wine Release Events, and <br /> Industry Events with outdoor amplified sound may be conditionally permitted as an <br /> accessory use to the Wineries and Wine Cellars — Winery, Small use type, which is a <br /> use type that is consistent with the A/G (General Agriculture) General Plan designation <br /> and may be conditionally permitted in the AG-40 (General Agriculture, 40-acre <br /> minimum) zone with an approved Site Approval application. In addition, a noise study <br /> was completed to ensure compliance with the Noise Standards specified in <br /> Development Title Section 9-1025.9 regarding stationary noise standards (50 dB Hourly <br /> Equivalent Sound Level daytime, 45 dB Hourly Equivalent Sound Level nighttime, 70 dB <br /> maximum sound daytime, 65 dB maximum sound nighttime). The study determined that <br /> permitting outdoor amplified sound during events would comply with the noise <br /> standards if events terminate prior to 10:00 p.m. However, pursuant to Development <br /> Title Section 9-1075.9(f)(1), outdoor amplified sound must already terminate at 9:00 <br /> p.m. As a result, the proposed addition of outdoor amplified sound is consistent with <br /> the goals, policies, standards and maps of the General Plan, and there are no Master <br /> Plans, Specific Plans, Special Purpose Plans, or any other applicable plan adopted by <br /> the County in the vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the existing services and improvements related to <br /> the existing development and proposed events are adequate. No new development is <br /> proposed with this application. The project will be served by an existing private septic <br /> system, an individual well,-and on-site storm drainage. No new buildings are proposed <br /> with this application. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 59.14 -acre parcel is of adequate size and shape <br /> to accommodate the proposed revision to allow the use outdoor amplified sound, when <br /> permitted, and the addition of twelve (12) marketing events for a maximum of eighty (80) <br /> people to the existing small winery. <br /> San Joaquin County PA-0900094/Bokisch <br /> Community Development Page 8 <br />
