.T <br /> s: <br /> RENTAL AGREEMENT <br /> Date <br /> RECEIPT IS HEREBY ACKNOWLEDGED by Hercules Vourakis <br /> Hereinafter called Owner, from Golden State Utility Co. <br /> Hereinafter called Tenants, of the sum of S. 1800.00 for the <br /> first month's rent and security deposit of the premises owned by said Owner and located <br /> at 18266 S. Austin Rd. Manteca Ca. 95336 which <br /> premises the Owner hereby agrees to rent to said Tenants on a month-to month basis <br /> based upon the following terms and conditions: <br /> I. TERMS: The terms of this agreement shall be a two-year lease, beginning on <br /> the 1St of July, 1999 and expire on the 30th of June, 2001. Upon mutual agreement <br /> between Owner and Tenant 60-days or more prior to the expiration of this lease, the <br /> lease may be renewed for one three-year period. <br /> 2. RENT: Tenant shall pay $800.00 per month beginning the 1st of July, 1999 and <br /> each and every month thereafter. Beginning the l"of July, 200I and every month <br /> thereafter until the 30''of June, 2004, Tenant shall pay$1,000.00 per month. <br /> 3. FAILURE TO PAY RENT: If the rental is not paid on or before the 5th day of each <br /> month, late charge of$120.00 shall apply in addition to the monthly rental. If the <br /> rental and late charge is not paid on or before the 10`h day of each month, the Owner, <br /> at his sole discretion, shall serve upon Tenant a Notice to Pay Rent or Vacate as <br /> provided by California Code Civil Procedure Section 1161. <br /> 4. SECURITY DEPOSIT: Receipt is hereby acknowledged by Owner the sum of <br /> 1000.00 as security deposit. Said sum shall be held by owner as security deposit for <br /> the faithful performance by Tenant of the terms of this tenancy agreement. <br /> Upon termination of this agreement, the entire security deposit shall be eligible to be <br /> refunded if the premises has been left in a clean and sanitary condition, if no <br /> deductions are required to repair any damage caused by Tenant or Tenant's guests, <br /> and if all payments of rent hereunder are paid. If however, said premises is not left in <br /> a clean and sanitary condition,undamaged, and with all rent paid in full, then Owner <br /> is hereby authorized to deduct such amounts as are reasonable necessary to satisfy <br /> these obligations of Tenant consistent with Civil Code Section 1950.5. Nothing shall <br /> prevent Owner from taking whatever legal action that is necessary to recover from <br /> Tenant the excess, if any, of costs so incurred by Owner over the balance of the <br /> security deposit. Upon termination or vacating, Owner shall refund to Tenant any <br /> remaining portion of the deposit no later than two (2) weeks thereafter. <br />
