5. USE OF PREMISES: Tenant agrees that said premises shall be used and occupied <br /> for no other purposes other than as allowed under the highway commercial zoning <br /> designation. <br /> 6. ASSIGNMENT AND SUBLEASING: Tenant shall not assign this agreement nor <br /> sublet said premises or and part thereof without the prior written consent of Owner <br /> and any such assignment or sublease, at the option of Owner, be void. <br /> 7. UTILITIES AND GARBAGE: Tenant shall pay for all utility and garbage services <br /> furnished to said premises and the accounts for the same shall be in the Tenant's <br /> name. <br /> 8. SURRENDER OF PREMISES: Tenant agrees on the last day of Tenant's tenancy <br /> hereunder to surrender to Owner said premises and appurtenances, goods and chattels <br /> belonging to Owner in the same condition as received,reasonable wear and tear <br /> expected. <br /> 9. OWNERS RIGHT OF ENTRY: Owner may enter said premises (offices and metal <br /> shop building) only in the following cases: <br /> a. In case of emergency. <br /> b. To make necessary or agreed repairs, alterations, or improvements, supply <br /> necessary or agreed services, or exhibit said premises to prospective or actual <br /> purchasers,mortgagees, workmen or contractors. <br /> c. When tenant has abandoned or surrendered the premises. <br /> d. Pursuant to court order. <br /> e. 24 hours notice shall be presumed to reasonable notice to Tenant. j <br /> f. Except in cases of emergency or when Tenant has abandoned or surrendered the <br /> premises, entry may not be made during other than normal business hours unless <br /> Tenant consents at the time of entry. <br /> 10. MAINTENANCE AND REPAIRS: <br /> a. Owner shall maintain said dwelling and grounds in a decent safe and sanitary <br /> condition, and shall comply with all state and local laws, regulations, and <br /> ordinances concerning the condition of office units. <br /> b. Tenant shall not paint, repair, or make any alterations to said premises,without <br /> prior written consent of Owner. <br /> c. Tenant shall keep and maintain said premises and appurtenances and every part <br /> thereof in good order and sanitary condition and repair and shall pay for any <br /> repairs thereto caused by his negligence or misuse or that of his invitee. Premises <br /> includes the portion of yard area surrounding said premises and rented as a part <br /> thereof. <br /> d. Tenant shall keep in repair and replace any plate glass and windows in the <br /> premises which may be broken during the continuance of this month-to-month <br /> tenancy. <br />
