e. Tenant shall be responsible for any damages caused by washing or cleaning <br /> walls, draperies, or carpets by the employment of an improper method or firm <br /> and for the cost of redoing the work if the method or firm employed is <br /> unsatisfactory. <br /> f Tenant shall pay for all damages from overflow of water or stoppage of waste <br /> pipes caused by Tenant's use. <br /> g. Nothing contained herein shall constitute a waiver, express or implied, of the <br /> Tenant's right under California Civil Code Sections 1941 and/or 1942. <br /> 11. PERSONAL PROPERTY INSURANCE: Tenant's personal property is not insured <br /> by the Owner, and Owner is not liable for any damage thereto, except as caused by <br /> unreasonable neglect, and Owner is not liable in any event for any damage to <br /> Tenant's property which could have reasonably been avoided by Tenant's giving <br /> notice to Owner of any defects in the premises or other potential cause of such <br /> damage. Tenant is advised and encouraged to carry his or her own policy of personal <br /> property insurance. <br /> 12. NOTICE UPON OWNER: Hercules Vourakis <br /> 18266 S. Austin Rd. Mantec Ca. 95336 <br /> Is hereby authorized to accept legal service on behalf of Owner. <br /> 13. USES PROHIBITED: Tenant shall not do or permit anything to be done in or about <br /> the premises nor bring or keep anything therein which will in any way increase the <br /> existing rate of or affect any fire or other insurance, or cause cancellation of any <br /> insurance policy covering Owner, the premises, or any part thereof, or any of its <br /> contents. <br /> 14. GOVERNMENT REGULATIONS: Tenant shall comply with all laws, ordinances <br /> and government regulations applicable to said premises or to the use thereof <br /> 15. RULES AND REGULATIONS: Tenant shall comply with all rules, regulations and <br /> management policies which are now, or may hereafter be, established for the <br /> premises by Owner. <br /> 16. ATTORNEY'S FEES: In the event that any action shall be commenced by either <br /> party hereto arising out of or concerning this agreement, or any right or obligation <br /> derived therefrom, then in addition to all other rights at law or equity, the prevailing <br /> party shall be entitled to recover reasonable attorney fees as fixed by the court. <br /> 17. INDEMNIFICATION OF OWNER: Tenant(s) shall hold Owner harmless and shall <br /> indemnify Owner for liability arising prior to the termination of this rental agreement <br /> for any injury or damage to any person or property whatsoever when such injury or <br /> damage is caused or permitted by an act, neglect, fault of, or omission of any duty <br /> with respect to the same Tenant(s), his family,his guests or invitees.
