NORTHERN HARRIER: Spring nesting surveys shall be conducted for the northern harrier to determine their presence or absence. If present, the nests shall be protected until the young have fledged. No construction or other disturbance would be allowed any closer than one-quarter mile from the nest until the young are able to fly well enough to avoid the construction zones. g. ' TRICOLORED BLACKBIRD: A nesting survey shall be conducted for tricolored backbirds to determine their presence or absence. If present, the nests shall be protected until the young have fledged. No construction or other disturbance shall be allowed any closer than 500 feet from the nest. h. WETLAND HABITATS: All created wetland habitats totaling 5.55 acres will be monitored annually by a qualified biologist over a five-year period to ensure that the created wetlands function as designed. Similarly, all planted vegetation will be monitored annually by a qualified biologist over a five-year period to ensure that, at a minimum, 80 percent of all plants survive. Each year, a monitoring report will be prepared by the applicant and submitted to the County of San Joaquin, DFG, FWS, and the U. S. Army Corps of Engineers. i. SAN JOAQUIN COUNTY MULTI-SPECIES HABITAT CONSERVATION AND OPEN SPACE PLAN (SJMSCP): As an alternative, the applicant may participate in and provide mitigation through the SJMSCP. 6. COUNTY OF SAN JOAQUIN OFFICE OF EMERGENCY SERVICES (Staff Contact: Dennis Fields, 468-3969) a. HAZARDOUS MATERIALS MANAGEMENT PLAN: A Hazardous Materials Management Plan (HMMP) shall be prepared and submitted to this office within 30 days after the beginning of operation. If hazardous materials are on the site during the construction phase for longer than 30 days, then an HMMP will be required by the responsible party of those hazardous materials. 7. LOCAL AGENCY FORMATION COMMISSION LAFCO (Staff Contact: Bruce Baracco, 468-3198) a. The applicant shall file a Reorganization application with LAFCO that demonstrates fire protection services to the subject property.
