1 <br /> Draft Supplemental Environmental Impact Report Page IV.F-22 <br /> Forward Inc.Landfill 2014 Expansion Project <br /> L' • A substantial adverse effect, either directly or through habitat modifications, on any special- <br /> status species identified as a candidate, sensitive, or special-status species in local or <br /> regional plans, policies or regulations,or by the CDFW or USFWS; <br /> • A substantial adverse effect on any riparian habitat or other sensitive natural community <br /> identified in local or regional plans,policies, or regulations, or by the CDFW or USFWS; <br /> • A substantial adverse effect on federally protected wetlands as defined by Section 404 of the <br /> Clean Water Act(including,but not limited to, marsh, vernal pool, coastal, etc.) through <br /> direct removal,filling, hydrological interruption, or other means; <br /> j� • Substantial interference with the movement of any native resident or migratory fish or <br /> wildlife species or with established native resident or migratory wildlife corridors, or <br /> impeding the use of native wildlife nursery sites; <br /> �. • A conflict with any local policies or ordinances protecting biological resources, such as a tree <br /> preservation policy or ordinance; or <br /> ■ A conflict with the provisions of an adopted Habitat Conservation Plan, Natural <br /> Community Conservation Plan, or other approved local,regional, or state habitat <br /> conservation plan. <br /> Impacts and Mitigation Measures <br /> For the purposes of this section, impacts and mitigation measures already required from past <br /> EIRs and project approvals are considered to be part of the proposed project, unless otherwise <br /> specified. Note that, for the purposes of document organization, impacts and mitigation <br /> measures below are labeled as "F_". These correspond to impacts and mitigation measures <br /> "H_" in the Summary section,for consistency with the 2013 EIR. <br /> Impact F.1. Filling of Waters of the U.S./Waters of the State. As part of the proposed project, <br /> the South Branch of the South Fork of Littlejohn's Creek would be relocated along the eastern <br /> and southern boundary of the proposed expansion area. This would result in the filling of 3000 <br /> feet of creek channel supporting 1.25 acres of wetlands and open water habitat subject to the <br /> jurisdiction of the USACE, CDFW and RWQCB. This is a potentially significant impact. <br /> During the last stages of landfill development, the proposed new main entrance road would <br /> cross the relocated creek channel. The creek crossing would be designed to span the creek,with <br /> all work avoiding areas under the jurisdiction of the USACE, CDFW, and RWCQB. <br /> ... Mitigation Measure F.1. Prior to site grading, the project sponsor shall obtain permits under <br /> Sections 401 and 404 of the Clean Water Act and Section 1602 of the California Fish and Game <br /> Code. These permits, administered by the RWQCB,USACE, and CDFW, respectively,would <br /> ` specify the mitigation measures to be imposed on the project as permit conditions. A Wetland <br /> Mitigation and Monitoring Plan shall be prepared and submitted for agency review to ensure a <br /> "no net loss" of wildlife value or acreage of wetlands or riparian habitat. At a minimum, the <br /> Plan shall include the creation of 4 acres of new wetlands and 9 acres of riparian plantings <br /> associated with the realigned creek channel, as presented in the conceptual design(Questa <br /> Engineering Corporation 2007) or as required by regulatory agencies. The Project Sponsor shall <br /> ensure that all mitigation areas, along with an appropriate upland buffer,be placed in a <br /> permanent conservation easement, or similar deed restriction, and preserved in perpetuity. <br /> The Wetland Mitigation and Monitoring Plan shall include the following details: <br />
