It is our understanding that the project proponent isseeking to overrule the San <br /> Joaquin Airport Land Use Commission finding that the expansion was incompatible with the <br /> Stockton Metropolitan Airport. We respectfully.request that the Board of Supervisors uphold the <br /> determination by the San Joaquin Airport Land Use Commission'that the proposed project is not <br /> consistent with the 1993 Airport Land Use Compatibility Plan for Stockton Metropolitan <br /> Airport. We contend that allowing the expansion And implementing mitigation strategies for,bird <br /> hazards is a poor application of public policy, it is far better to prevent the Hazard than to <br /> mitigate it. Based on our in-depth knowledge of federal guidelines and regulations; it is our <br /> belief that this project does not meet Federal Aviation Administration guideliries.and standards <br /> as outlined in Advisory Circulars 150/5200-.33B and 34A. <br /> Contrary to the proponent's assertion in their declaration that Advisory Circulars are only <br /> advisory In nature, Advisory Circulars become regulatory under the FAA's Airport Improvement - <br /> Program Sponsor Grant Assurance L This assurance incorporates by reference all Applicable <br /> Federal laws, regulations, executive orders,policies, guidelines, and requirements as they relate <br /> to the application, acceptance and use of Federal funds fox making airport improvements. As the <br /> sponsor for Stockton Metropolitan.Airport, San Joaquin County has a long history of accepting <br /> federal finds for-airport improvement projects and must abide by these)brant assurances, <br /> Further, Grant Assurances 20 and 21 which govern Hazard Removal and Mitigation and <br /> Compatible Land Use respectively are also enumerated in 49 USC §47107 a.
