The Aircraft Owners and Pilots Association(AOPA) represents the general aviation interests of nearly 400,000 members; more than two-thirds of the nation's pilots—including more than 42,QQ0 in the state of California, AOPA is committed to ensuring the future safety,viability and development of general aviation airports and their facilities as part-of a national and state transportation system. We-previously filed comments in opposition to the.proposal by Forward Landfill to expand an existing landfill. It is our understanding that the project proponent isseeking to overrule the San Joaquin Airport Land Use Commission finding that the expansion was incompatible with the Stockton Metropolitan Airport. We respectfully.request that the Board of Supervisors uphold the determination by the San Joaquin Airport Land Use Commission'that the proposed project is not consistent with the 1993 Airport Land Use Compatibility Plan for Stockton Metropolitan Airport. We contend that allowing the expansion And implementing mitigation strategies for,bird hazards is a poor application of public policy, it is far better to prevent the Hazard than to mitigate it. Based on our in-depth knowledge of federal guidelines and regulations; it is our belief that this project does not meet Federal Aviation Administration guideliries.and standards as outlined in Advisory Circulars 150/5200-.33B and 34A. Contrary to the proponent's assertion in their declaration that Advisory Circulars are only advisory In nature, Advisory Circulars become regulatory under the FAA's Airport Improvement - Program Sponsor Grant Assurance L This assurance incorporates by reference all Applicable Federal laws, regulations, executive orders,policies, guidelines, and requirements as they relate to the application, acceptance and use of Federal funds fox making airport improvements. As the sponsor for Stockton Metropolitan.Airport, San Joaquin County has a long history of accepting federal finds for-airport improvement projects and must abide by these)brant assurances, Further, Grant Assurances 20 and 21 which govern Hazard Removal and Mitigation and Compatible Land Use respectively are also enumerated in 49 USC §47107 a. (9) and..(10).and are therefore Federal law that the.County must abide by as well. The FAA San Francisco AIRCRAFT OWNERS AND PILOTS ASSOCIATION
