Draft Environmental Impact Report Page I-2 <br /> Forward Inc. Landfill Expansion <br /> development under that permit as the baseline for impact assessment. Impacts that would occur as a <br /> r <br /> result of permit revisions set forth in the current permit application are addressed in this EIR. <br /> As discussed above, the existing Forward Landfill is currently permitted for landfill operations. A <br /> number of Appellate Court cases have found that where a specific project has previously undergone <br /> CEQA review and has been approved, any subsequent CEQA Q review of any proposed modification to <br /> the previously approved project should be limited to the incremental impacts associated with the <br /> proposed change in the project-' Therefore,the County has determined that the full development <br /> allowed under the landfill's existing permits should be used as the environmental baseline <br /> (Environmental Setting). This baseline of full development under existing County Use Permit differs <br /> from currently existing physical conditions. The EIR's analysis of the potential impacts of the proposed <br /> consolidated landfill project is based on a comparison of the proposed project with full buildout of the <br /> currently permitted landfill. Most mitigation measures have been incorporated into the existing <br /> permits and therefore are considered part of the environmental baseline. Forward Inc. proposes to <br /> incorporate those mitigations that are still applicable into the proposed project. Mitigations proposed <br /> as part of the project; along with additional measures, are identified as such under each section of <br /> Chapter IV. Environmental Setting, Impacts, and Mitigation Measures and-discussed in Chapter III, <br /> Project Description. <br /> D. PUBLIC REVIEW PROCESS <br /> The San Joaquin County Community Development Department issued the Notice of Preparation for <br /> this EIR on May 8,2008. The NOP is included as Appendix A to this EIR. The NOP was circulated to <br /> applicable local and state agencies, and interested parties and responses were received from the San <br /> PP g <br /> Joaquinuin County PublicWorks Department, the San Joaquin Count <br /> Environmental Health Department, <br /> the California Integrated Waste Management Board, the California Department of Conservation,the <br /> San Joaquin Farm Bureau Federation,the San Joaquin Valley Air Pollution Control District,the San <br /> Joaquin County Organization of Governments (SJCOG-two letters), and the Manteca Union School <br /> District. These response letters are included in Appendix B. <br /> CEQA Guidelines Section 15082 (c) (1)requires that"For projects of statewide,regional, or areawide <br /> significance pursuant to section 15206, the lead agency shall conduct at least one scoping meeting." <br /> Section 15206 includes a list of specific criteria for regional significance, including industrial projects of <br /> over 40 acres and projects that would result in the cancellation of a Williamson Act contract of over 100 <br /> acres. On the basis of these criteria, San Joaquin County has determined that the proposed project <br /> would be a project of regional or areawide significance, and held a scoping meeting on February 5, ` <br /> 2009. Comments received at that meeting are summarized in Appendix B. <br /> This Draft EIR is circulated for a 45-day public review and comment period. All relevant comments on <br /> environmental issues received during the public review period will be responded to in the Final EIR <br /> (FEIR). That IiEIR will need to be certified by the county as complete and adequate prior to approval of <br /> the County Use Permit. In order to approve the project,the County also is required to make necessary <br /> findings under CEQA section 15091, and adopt a Mitigation Monitoring and Reporting Program <br /> (MMRP). The MMRP will incorporate all mitigation measures ultimately required by the County. <br /> E.
