This
far-reaching plan, with innovative measures and a "dual path" strategy, assures
expeditious attainment of the federal 8-hour ozone standard for all Valley
residents. The CARB approved the plan on June 14,2007.
• On September 25, 2008, EPA re-designated the San Joaquin Valley to "attainment"
for the PM10 NAAQS and approved the PM10 Maintenance Plan. The District
Governing Board adopted the 2008 PM2.5Plan following a public hearing on April
30,2008. This far-reaching plan will assure that the Valley will attain all the PM2.5
standards-the 1997 federal standards, the 2006 federal standards, and the state
standard-as soon as possible."
The S VAPCD regulates, permits, and inspects stationary sources of air pollution, while
the State is responsible for emission standards and controlling actual tailpipe emissions
from motor vehicles. For the Forward Landfill, the relevant rules and regulations
include:
• Rule 2201 —requires new and modified stationary sources of emissions to
mitigate emissions using best available control technology and to offset emissions
when above thresholds."
• Rule 4102 Odors establishes odor management practices and requirements to
reduce odors from creating a nuisance off site.
• Rule 8011 Dust—requires implementation of dust suppression techniques to
prevent fugitive dust from creating a nuisance off site.
• Rule 9510—requires reductions of 20 percent of the NO,, construction emissions
and 45 percent of the PM10 construction emissions, or payment of fees to offset
NO),or PM10 construction emissions not reduced to the specified levels."
Assembly Bill 32– California Global Warming Solutions Act
In 2006, California passed the California Global Warming Solutions Act of 2006
(Assembly Bill No.32;California Health and Safety Code Division 25.5, Sections 38500, et
seq., or AB 32),which requires the CARB to design and implement emission limits,
s San Joaquin Valley Ozone Plans,http://www.valleyair.ors/Air Quality Plans/Ozone Plans.htm
" San Joaquin Valley Particulate Matter Plans,http://www.valleyair.org/Air Quality_P1anSIPM Plans.htm
1° San Joaquin Valley Air Pollution Control District,
http://www.valleyair.org/transl2ortation/ceqa rules.h_tm
" District Rule 9510 Indirect Source Review(ISR)was adopted December 15,2005.ISR was adopted to fulfill
the District's emission reduction commitments in the PM,,and Ozone Attainment Plans.ISR requires
submittal of an Air Impact Assessment(AIA)application no later than the date on which application is made
for a final discretionary approval from the public agency. The AIA outlines construction and operational
mitigation requirements as well as fee schedules.
