On December 12, 1994(after the EIR was <br /> completed)the City of Stockton adopted an ordinance and two resolutions establishing the City's <br /> "Habitat and Open Space Conservation Fee". This fee program may be used to establish an agricultural <br /> land trust by acquiring conservation easements to protect wildlife,while assuring long-term preservation <br /> of agricultural lands and operations. The Initial Study also found several areas where,due to changed <br /> physical and regulatory conditions since 1994,potentially significant environmental impacts could result. . <br /> These are land use,biological resources,traffic,and water quality:-The Initial Study.focusing out the <br /> other environmental issues is included as Appendix A of this Supplemental Environmental Impact Report <br /> (SEIR). <br /> This level of changes triggers further environmental review under CEQA. In this case,because there <br /> could be new significant impacts,it was determined that preparation of a focused SEIR,as specified <br /> under CEQA Guidelines Section 15163,would be the appropriate CEQA documentation for this project. <br /> Specifically,the major changes in project conditions addressed in this SEIR are: <br /> • Change in jurisdiction from the City of Stockton to the County of San Joaquin <br /> • New approved and proposed development and circulation system modifications have substantially <br /> altered traffic conditions in the project area. <br /> • Several new species have been added to state and/or federal protected species lists,there has been <br /> some change in sensitive species considered possible to occur in the project area, and the proposed M <br /> realignment of the North Branch of the South Fork of Little Johns Creek has changed. <br /> • New studies of groundwater contamination have identified a more widespread contaminant plume <br /> than addressed in the:1994 EIR,and changes to remediation plans have been made to respond to this <br /> new information. <br /> This SEIR includes sections addressing the four environmental topics above,but does not include the <br /> other environmental issues in the 1994 EIR that were focused out of this SEIR The section numbers in <br /> this SEIR for the four topics above correspond to those of the 1994 EIR As a consequence,the section <br /> numbers of the environmental issues in this SEIR are not sequential. <br /> A Draft SEIR requires circulation similar to a Draft EIR. All relevant comments on environmental issues <br /> received during the public review period will be responded to in a Final Supplemental EIR That EIR <br /> would need to be certified by the County as complete and adequate priorto approval of the project. In <br /> order to approve the project,the County also would be required to make necessary findings under CEQA <br /> Guidelines section 15091 and adopt a Mitigation Monitoring and Reporting Program(MMRP). The <br /> MMRP shall incorporate the change in jurisdiction from the City of Stockton to San Joaquin County,as <br /> discussed above. <br /> GRAS=ENVIRONMENTAL CONSULTING <br />
