There continues to be no definitive noise <br /> "signature"associated with landfill traffic in that landfill traffic volumes on Austin Road are higher north of the <br /> landfill than to the south, but noise levels are approximately equal in either direction from the landfill <br /> entrance. <br /> Regulations Plans, and Policies <br /> Noise regulations, plans, and policies have not change substantially since certification of the Austin Road <br /> Landfill EIR (1994). San Joaquin County is currently in the process of adopting a new County noise <br /> ordinance. The County noise ordinance creates the following noise performance standards (dBA) at any <br /> "outdoor activity area"such as rearlside yards of residences: <br /> 7 a.m.— 10 P.m. 10 p.m.—7 a.m. <br /> Average Level(Leq) 50 45 <br /> Maximum Level(Lmax) 70 65 <br /> The FEIR was based upon project compliance with the City of Stockton noise standards, which are as <br /> follows(dBA): <br /> 7a.m.-10 .m. 10p.m.-7a_m. <br /> Average Level(Leq) 55 45 E <br /> Maximum Level(Lmax) 75 65 <br /> The daytime standards under the new County ordinance are.5 dB more stringent that the City standard. <br /> The FEIR identifies noise levels exceeding the City ordinance level as a potentially significant impact. <br /> Although the new County noise standard is 5 dB more stringent,there is no jurisdictional change associated - <br /> with project implementation. Continued compliance with Mitigation Measures H.1(a) and H.1(b) will <br /> maintain a less-than-significantnoise impact. <br /> Traffic Data Update <br /> Updated traffic noise studies in the BNSF Intermodal Facility Noise Report(1999)show a future traffic noise <br /> level of 74 dB Ldn between 2000 and 2010 at 50 feet from the Austin Road centerline north of the landfill <br /> entrance. Table III.H.4 of the FEIR shows a traffic noise level of 74 dB Ldn in 2005. There have been no <br /> new data that would indicate that FOR traffic noise estimates do not continue to be valid. <br /> Baseline conditions have not changed, significance criteria and associated mitigation measures are still <br /> valid, and new data on traffic conditions does not measurably alter previous conclusions reached in the <br /> FEIR. There are no new impacts not previously adequately discussed in the FEIR. <br /> The project sponsor shall conduct a bird survey before construction of the project and monitor bird <br /> population after operation of the landfill expansion begins.
