d. Impacts on Swainson's Hawk Breeding and Nesting <br /> Potential Significant Impact(F.4): <br /> Implementation of the proposed project may result in the loss of a Swainson's hawk breeding <br /> territory and disturbance of nesting Swainson's hawks. <br /> Finding. <br /> Based upon the analysis in the EIA,monitoring of landfill construction and expansion activities, <br /> planting of trees,and provision of Swainson's hawk habitat will make impacts on Swainson's <br /> hawk breeding nesting less than significant. <br /> The following mitigation measures will mitigate these impacts to below a level of significance. <br /> Mitigation Measures (Impact F.4): <br /> (a)Preconstruction surveys for Swainson's hawks shall be conducted by the SJMSCP <br /> JPA. <br /> (b)Implement Mitigation Measures F.1 (a-b):Planting of native tree species in <br /> association with the Wetland Mitigation and Monitoring Program and along the landfill <br /> perimeter and buffer area would provide potential future nesting substrate for the <br /> Swainson's hawk, including after anticipated closure of the proposed landfill in 2045. <br /> (c)Implement Measure F.3(c)above, to mitigate for habitat loss. <br /> Facts in Support of the Finding: <br /> I <br /> The potential for loss of Swainson's hawk breeding territory and disturbance of nesting <br /> Swainson's hawks is discussed in Section IILF of the EIR. The measures above are designed to <br /> mitigate these effects,and incorporate the San Joaquin County Multiple-Species Conservation <br /> and Open Space Plan,the Wetland Mitigation and Monitoring Program,and policies and <br /> recommendations of the California Department of Fish and Game. ` <br /> e.Removal of Bird Habitat <br /> Potential Significant Impact(F.5): <br /> Implementation of the proposed project would remove approximately 213.9 acres of foraging <br /> habitat for the California horned lark,mountain plover,northern loggerhead shrike and northern <br /> harrier. In addition,marginal nesting habitat is present on site for the California horned lark and <br /> Northern harrier. <br /> Finding: <br /> Based upon the analysis in the EIR,measures for creek,wetland,and Swainson's hawk habitat <br /> mitigation will make impacts on habitat of the California horned lark,mountain plover,northern <br /> loggerhead shrike and northern harrier less than significant. <br /> 28 <br />
