U U <br /> First, an Initial Study was prepared, dated November 5, 1994, based on the 1994 EIR and supplemental <br /> reports and permits. The Initial Study updated the 1994 EIR and found that, for most of the environmental <br /> topics, there were no substantial changes in background conditions and that the EIR's analysis remained <br /> valid. The Initial Study confirmed the EIR's findings of significant unmitigable impacts on visual quality and <br /> cumulative air quality. it also concurred with the 1994 EIR's conclusion of significant unmitigable and use <br /> impact resulting from conversion of agricultural lands. Finally, the Initial Study found four areas where, due <br /> to changed physical and regulatory conditions since 1994, potentially significant environmental impacts <br /> r <br /> could result. These are: <br /> 4 Land use, plans, and policies. ; <br /> Biological resources. ' <br /> 0 Traffic. <br /> F <br /> e Water quality. I� <br /> Second, the potentially significant impacts identified in the Initial Study were addressed in a focused <br /> Supplemental Environmental Impact Report (SEIR). This Draft SEIR will be circulated for public review <br /> similar to a Draft EER. All relevant comments on environmental issues received during the public review <br /> period will be responded to in a Final Supplemental EIR. In order to approve the project, the County is <br /> required to certify the Final SEIR and make necessary findings under CEQA Guidelines Section 15091 and <br /> adopt a Mitigation Monitoring and Reporting Program. <br /> A hearing on the Draft EIR was held for the Planning Commission on December 2, 1999. Comments <br /> received on the Draft EIR are included in the Final EIR. All oral and written comments received during the f <br /> 30-day review period for the Draft EIR have been responded to and included in the Final EIR. Where <br /> necessary,the text of the draft document has been amended as a result of the public review process.. <br /> Determination of Adeguacy of the Final EIR <br /> The only determination to be made by the Commission in order to certify the EIR is whether or not it is t <br /> adequate as described in Section 15151 of the CEQA Guidelines. This section states in part that"an EIR <br /> should be prepared with a sufficient degree of analysis to provide decision makers with information which <br /> enables them to make a decision which intelligently takes account of environmental consequences. An <br /> evaluation of the environmental effects of a proposed project need not be exhaustive, but the sufficiency of <br /> an EI R is to be reviewed in light of what is reasonably feasible." it is staffs determination that the EIR meets <br /> the intent of this section. The document thoroughly discusses all issues identified in the Initial Study, j <br /> contains all sections required by law, and adheres to all review periods and time requirements. All issues <br /> raised during the review of the draftdocument are thoroughly discussed in the Final EIR. <br /> POLICY CONSIDERATIONS <br /> General Plan I� <br /> The landfill site is a non-contiguous City of Stockton island that is owned and operated by the City. State jI <br /> law allows cities to annex non-contiguous property up to 300 acres if it is used for public purposes. The , <br /> property containing the existing landfill was annexed by the City from San Joaquin County in 1984. Part of <br /> the proposed expansion area (the Brocchini parcel,the triangle property,and the southernmost 20 acres of <br /> the CYA parcel)was annexed in 1997. The total property annexed is 297 acres.
