" <br /> The subject property contains 460 feet of unobstructed frontage <br /> along Banta Road. However, the applicant has elected to locate <br /> Parcel 1, the homesite parcel, 330 feet east of Banta Road. Access <br /> to Parcel 1 is proposed from Banta Road by means of a 25-foot-wide <br /> access easement over the 25-foot-wide fee strip which is part of <br /> APN 252-110-04, owned by Lynn and Kay Frigard. The court order of <br /> November 22, 1989, stated that the applicants are owners of a 25- <br /> foot-wide easement "to be used as a roadway for all types of <br /> vehicular and pedestrian ingress and egress incident to their <br /> residential real property and agricultural and dominant tenement. " <br /> The Department of Public Works is requiring an Irrevocable Offer <br /> to Dedicate the 25-foot-wide right-of-way along the south property <br /> line of APN 252-110-04 from Banta Road to the east property line <br /> of Parcel 1. The Irrevocable Offer to Dedicate would have to be <br /> obtained from the owners of the 25-foot-wide strip, Lynn and Kay <br /> Frigard. <br /> ENVIRONMENTAL CONSIDERATIONS: <br /> An Initial Study was prepared for this project on August 29, 1990, <br /> and no significant effects on the environment were identified. On <br /> the basis of the Initial Study, a Negative Declaration was <br /> prepared. <br />
