i <br /> E <br /> CONDITIONS OF APPROVAL <br /> SA-01-94 <br /> Southland Corporation <br /> Site Approval Application No. SA-01-94 was approved by the San Joaquin County Planning <br /> Commission on January 16, 2003. The effective date of approval is January 26,2003.Iii This approval <br /> will expire on July 27, 2004, which is 18 months from the effective date of approval; unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits have been <br /> secured and remain in force, and (3) all necessary permits from other agencies have.been secured <br /> and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> I <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. BUILDING PERMIT: Submit an"Application—Commercial Building permit." The Site Plan <br /> required as a part of the building permit must be prepared by a registered civil engineer or licensed <br /> architect This Plan must show drainage, driveway access details(including gates,)on-site parking, <br /> landscaping, signs, existing and proposed utility services, and grading(refer to the"SITE PLAN <br /> CHECK LIST'for details). A fee is required for the Site Plan review. (Development Title Section 9- <br /> 884) <br /> b. APPROVED USE: This approval is for a fueling facility with four gasoline dispensers, a 40-foot <br /> by 50-foot canopy, and a monument sign as shown on the Plan submitted December 24, 2001. <br /> c. LIGHTING: Any lighting shall be designed to confine direct rays to the premises. No spillover <br /> beyond the property lines shall be permitted except onto public thoroughfares, provided, however <br /> that such light shall not cause a hazard to motorists. [Development Title Section 9=1015(g)(4)] <br /> i <br /> d. LANDSCAPING: A minimum 10-foot-wide landscaped strip, respecting the ultimate right-of-way <br /> width of 84 feet for Benjamin Holt Drive and 60 feet for Grigsby Place, shall be installed across ! <br /> the frontage of the project site. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> l <br /> a. An encroachment permit shall be required for work done within the road right-of-way. <br /> (Development Title Sections 9-1145.4 and 9-1145.5) <br /> I <br /> b. The driveway approach shall be improved in accordance with the requirements of San Joaquin <br /> County Standards CW-C11 prior to issuance of the occupancy permit. (Development Title <br /> Section 9-1145.5) <br /> c. The Traffic Impact Mitigation Fee may be required for this development. The fee is due and k <br /> payable at the time of building permit application. The fee currently is $176.84 per additional <br /> daily trip-end generated in the Stockton area. The fee shall be automatically adjusted July 1 of <br /> each year by the Engineering Construction Cost Index as published by the Engineering News i <br /> Record.
