a <br /> - Analysis <br /> Background <br /> The creation of a homesite parcel, which would normally be processed with a Minor Subdivision <br /> application, is being processed with a Major Subdivision application. The State Subdivision Map Act <br /> (Section 66426) requires a final map for any subdivision that creates five or more parcels. <br /> Minor Subdivision Application No. MS-88-33 was approved for the current owner of the subject property <br /> on November 27, 1987, to create four parcels of 40 or more acres. The owner's proposal to subdivide <br /> a homesite parcel from one of the previous subdivision's 40-acre parcels would result in a fifth parcel <br /> being created from the original parcel by the same subdivider. The fifth parcel triggered the requirement <br /> for a Major Subdivision application. <br /> General Plan/Zoning Consistent <br /> The site's General Plan and zone designations are AIG (General Agriculture) and AG-40 (General <br /> Agriculture, 40-acre minimum parcel size), respectively. The property owner has owned the property for <br /> over ten years and has not previously created a homesite parcel at this location. The proposed density <br /> of development, parcel width, and parcel size are consistent with the requirements of the Development <br /> Title. <br /> ' A mobile home is located to the east of the shop on proposed Lot 1. The mobile home appears to have <br /> been placed on the property without the necessary permits. A Condition of Approval is recommended <br /> which requires that either the mobile home be removed or the required permits be obtained. <br /> Williamson Act <br /> Because the property is under a Williamson Act contract, in order to subdivide the property and create <br /> a homesite parcel, Section 66474.4 of the Government Code requires that the property owner has owned <br /> the property for ten years and that a residence has existed on the property for five years. The proposed <br /> subdivision meets these requirements. <br /> Flooding <br /> The site is within flood hazard zone A-21 and is subject to flooding to an elevation of 11 feet above mean <br /> sea level.
