Neither the design of the subdivision nor any proposed improvements are likely to cause substantial <br /> f environmental damage or substantially and avoidably injure fish or wildlife or their habitat. <br /> f This finding can be made because the various mitigation measures identified in the Initial <br /> Study will reduce the potential impacts the project may have on the environment. The <br /> Department of Fish and Game has determined that, by participating in the San Joaquin <br /> Multi-Species Conservation Plan (SJMSCP),the applicant can minimize or mitigate for the <br /> conversion of 90 acres of open-space to non-open space. It is also recommended as a <br /> Condition of Approval that the applicant mitigate for the loss of 90 acres of agricultural <br /> land by implementing one or more of the available mitigation measures for the loss of <br /> agricultural land. The oak grove located at the northern end of the property is not <br /> proposed for development. The oaks trees as shown on the tentative map shall not be <br /> removed, and the drip lines of the oak trees along the eastern boundary will be protected <br /> in accordance with Development Title Section 9-1505.5. <br /> 6. The design of the subdivision or type of improvement is not likely to cause significant public health <br /> problems. <br /> • This finding can be made because any conditions attached to the approval will address <br /> any potential public health problems. <br /> 7. The design of the subdivision or the types of improvements will not conflict with easements acquired <br /> by the public at large for access through or use of property within the proposed subdivision. <br /> • This finding can be made because the design of the subdivision and improvements will <br /> not conflict with easements, acquired by the public at large,for access through or use of <br /> the property within the proposed subdivision. The Department of Public works <br /> recommends as a Condition of Approval that the applicant provide public utility . E <br /> easements along the road frontage of the subdivision and as required by public utility ! <br /> companies. If alternate easements for access or for use are necessary,then these will be <br /> substantially equivalent to those previously acquired by the public. <br /> 8. Any land or improvements to be dedicated to the County or other public agency is consistent with the <br /> General Plan, any applicable Specific Plan and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because all land and Improvements to be dedicated to the <br /> County are consistent with the General Plan,any applicable Specific Plan and Special <br /> Purpose Plan,and other applicable plan adopted by the County. The Department of Public <br /> Works recommends as a Condition of Approval that the applicant dedicate and improve all <br /> Interior streets and cul-de-sacs and provide an Offer of Dedication of ground water rights. <br /> In addition, access rights shall be dedicated and restricted for residential lots along the <br /> frontage of Brandt Road and along the frontage of Jack Tone Road.
