At the time Mr. Rtstar.a was granted a
"conditional will serve letter" he had the oE)portunity to purchase 89 sewer units
that were available, that could have been used to start his development, but these
were not picked up by Mr. Pestana. Most of those credits llav;.since been
allocated to other projects in the district. For this project to start more land for
wastewater disposal will have to be provided. LCSD has atterr -ted to purchase
two different parcels of land this past year to increase its wastewater disposal
capacity. One parcel was deemed too encumbered with wetlarns, and the other
was withdrawn by the seller when they found out that the Distp:ct was purchasing
the land for disposal use. Since landowners around our treatment plant have been
unwilling to sell land to the District it would appear that a case of-eminent
domain" might be needed to procure the land needed to accornrrodate this project. `
Please call me if you have any questions on this.
Sincerely,
Joseph Salzman _
District Manaber
LCSD
