rt
t Other subdivision development in the surrounding area is not being
penalized by this requirement.
Chief Deputy County Counsel Mike McGrew pointed out that the
Department of Fish and Game has the enforcement power for their
conditions of approval, and the applicant may negotiate with them
on modification of their conditions.
Preston Ledbetter, Vice President of the Clements-Lockeford Chamber
of Commerce (13480 E. Highway 88, Lockeford) , said that there are
5 hawk nests in the community, but there are none on this site. He
said he was in support of this project.
Larry Jauregui (13821 Sharon Drive, Lockeford) said he was in
support of the project.
Jerry Busby (13157 Brandt Road, Lockeford) , Fire Chief of the
Mokelumne Rural Fire District, said that a site has been set aside
for a fire station; that Mr. Arismendi is willing to support the
community; the issue of fire safety has been addressed and the
concerns have been mitigated; and the fire department is now
negotiating for equipment.
OPPONENTS: Ed Holden (18935 Tully Road, Lockeford) , said that the
subdivision is great, but he is keeping his option open on the
water issue. He is against the decorative, 26-acre mosquito fish
pond. The water is needed; there is no surface feed for the lake
("other than sucking it out of the ground") . This is not a right
use of water.
REBUTTAL: Mr. Arismendi said he had no specific rebuttal, but he
is willing to hold the County harmless if they delete the condi-
tions on the Swainson hawk.
PUBLIC HEARING CLOSED
Comm: Gillispie suggested that Condition No. 5. (a) be revised to
read: "All graded ground surfaces other than the proposed lake
shall be graded to prevent ponding. "
There was considerable discussion regarding the Fish and Game
Conditions of Approval as to whether or not to leave them as
written or to delete them.
MOTION: Moved, seconded (Jungeblut-Rojas) and carried by a vote of
5 to 1 to:
I
1. Certify as adequate Final Environmental Impact Report No. ER-
90-3 under the provisions of Section 15090 of the California
Environmental Quality Act (CEQA) .
2 . Recommend to the Board of Supervisors approval of a Resolution
Repealing the Specific Road Plan for Sharon Drive from Jack
Tone Road to Tully Road (Attachment C) .
-5-
