E <br /> I <br /> CONDITIONS OF APPROVAL_ <br /> UP-97-6 <br /> Muellerleile <br /> Use Permit Application No. UP-97-6 was approved by the San Joaquin County Planning <br /> Commission on August 28, 1997. The effective date of approval is September 7, 1997. This <br /> approval will expire on March 9, 1999, which is 18 months from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with, (2) all necessarybuilding permits <br /> have been secured and remain in force, and (3) all necessary permits from other agencies have <br /> been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> fulfilled prior to the establishment of the use and the issuance of any building permits. Those <br /> Conditions followed by a Section Number have been identified as Ordinance requirements <br /> pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance <br /> requirements may apply. <br /> Y Pp Y• <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Kerry Sullivan, 468-3140) <br /> a. BUILDING PERMIT: Submit an "Ag or Garage Building Permit" application. The Site <br /> Plan required as a part of the building permit must show drainage, driveway access <br /> details (including gates), on-site parking, landscaping, signs, existing and proposed utility <br /> services, and grading (refer to the "Site Plan Check List" for details). A fee is required <br /> for the Site Plan review. (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is for a breeding kennel for up to 50 dogs as shown on <br /> the Plan submitted June 24, 1997. <br /> C. BUSINESS LICENSE: The applicant shall secure an approved Business License' prior <br /> to the initiation of the use. The Business License may be applied for concurrently with <br /> the building permit application. (County Ordinance Code Section 7-1000) <br /> d. ANIMAL REGULATIONS: The following animal regulations apply and shall be <br /> provided: <br /> 1 O All animal enclosures, includingbut not , <br /> limited to e <br /> pens, cages, and feed areas, { <br /> shall be maintained free from litter, garbage, and excessive accumulation of <br /> manure so as to discourage the proliferation of flies, other disease vectors, and <br /> offensive odors. The premises shall be maintained in a neat and sanitary <br /> manner. (Development Title Section 9-1045(b)) <br /> (2) Except for movement on and off the property, animals shall not be kept or <br /> maintained in coops, pens, corrals, or within bams or similar structures on <br /> property less than 112 acre and closer than 40 feet from any rear or side property <br /> line.
