Mitigation Measure: Conduct protocol surveys, and prepare a Conservation Plan for vernal pool fairy shrimp and vernal pool tadpole shrimp if they are present in a pool within the excavation area that cannot be avoided via redesign of excavation boundaries. If vernal pool fairy shrimp and vernal pool tadpole shrimp are not found within the excavation boundaries, no further mitigation measure for these species is required. • Monitoring Re uirement: Conduct protocol surveys prior to excavation of areas containing vernal pools. • Person/Agency Responsible: USFWS. • Timing or Frequency of Monitoring: Prior to excavation in phases containing vernal pools. Mitigation Measure: A survey for nesting raptors shall be conducted by a biologist during spring or early summer (April - July) before the start of each phase of excavation activities near any of the six identified nest trees. If an active nest is located within 500 feet of an excavation area, the tree shall be avoided during the nesting season (March - June 15) until the young have fledged. If an active nest tree cannot be avoided, the removal shall occur after the breeding season (after June 15 and before March 1). • Monitorin Re uirement: Conduct surveys for nesting raptors. • Person/Agency Responsible: DFG. • Timing or Frequency of Monitoring: Prior to excavation in phases containing the six identified nest trees shown on the Biological Resources map. Mitigation Measure: If an active nest site is found within 0.5 miles of the disturbance site, consult with DFG and follow. DFG's Mitigation Guidelines for Swainson's Hawks in the Central Valley (California Department of Fish and Game, 1994). • Monitoring Requirement: Consult with DFG. • Person/Agency Responsible: DFG. • Timing or Frequency of Monitories Prior to excavation near active nest sites. Mitigation Measure: Compensate for the loss of Swainson's hawk foraging habitat by providing 75 acres of suitable Swainson's hawk foraging habitat.
