SMARA Section 2772 (h) requires that the description of <br /> reclamation measures be adequate for the proposed end use. <br /> The subsequent use for this site is rangeland. The <br /> reclamation plan for this site, which is currently under a <br /> Williamson Act Contract, does not describe appropriate <br /> methods for reclaiming to rangeland. <br /> 3. SMARA Section 2772 (j ) requires that the reclamation plan <br /> include a statement from the applicant accepting <br /> responsibility for reclamation of the mine site according to <br /> the approved reclamation plan. The plan should be amended <br /> to include an applicant statement of responsibility. <br /> 4 . SMARA Section 2773 (a) requires that the reclamation plan <br /> establish "site-specific criteria for evaluating compliance <br /> with the approved reclamation plan, including topography, <br /> revegetation, sediment and erosion control . " Minimum <br /> standards should be developed by the operator in conjunction <br /> with the lead agency and DMG. For example, the standards <br /> should specifically state the amount of vegetative cover, <br /> density, and diversity to be attained over a specific <br /> i monitoring period. For revegetation elements, monitoring <br /> should be conducted for a minimum of five years following <br /> implementation. Monitoring should be done on an annual <br /> basis with reports submitted to the lead agency and DMG. <br /> The monitoring program should address the stability and <br /> success of the rehabilitated areas, compare these areas to <br /> baseline conditions and performance standards, and suggest <br /> remedial measures, where needed. The review of the reports <br /> by agency personnel should allow for modifications in <br /> monitoring, rehabilitation, or revegetation. <br /> 5. CCR Section 3502 (b) (1) requires that the reclamation plan <br /> include a description of the environmental setting of the <br /> mined site. The submitted reclamation plan describes the <br /> site as native grasses and oaks . A more thorough <br /> # description of the biotic setting of the site is necessary <br /> r for three reasons, 1) to document baseline conditions <br /> (especially withregard to the quality of the rangeland) , <br /> 2) to aid in development and evaluation of an appropriate <br /> revegetation plan, and 3) to evaluate purported mining and <br /> reclamation impacts on wildlife habitat. <br /> 6. CCR Section 3502 (b) (3) states that the designed steepness <br /> and proposed treatment of the mined lands ' final slopes take <br /> into consideration the physical properties of the material, <br /> landscaping requirements, and other factors.
