a '
a
Mr. Chandler Martin
Page 2
2 . SMARA Section 2772 (h) requires that the description of
reclamation measures be adequate for the proposed end use.
The subsequent use for this site is rangeland. The
reclamation plan for this site, which is currently under a
Williamson Act Contract, does not describe appropriate
methods for reclaiming to rangeland.
3. SMARA Section 2772 (j ) requires that the reclamation plan
include a statement from the applicant accepting
responsibility for reclamation of the mine site according to
the approved reclamation plan. The plan should be amended
to include an applicant statement of responsibility.
4 . SMARA Section 2773 (a) requires that the reclamation plan
establish "site-specific criteria for evaluating compliance
with the approved reclamation plan, including topography,
revegetation, sediment and erosion control . " Minimum
standards should be developed by the operator in conjunction
with the lead agency and DMG. For example, the standards
should specifically state the amount of vegetative cover,
density, and diversity to be attained over a specific
i monitoring period. For revegetation elements, monitoring
should be conducted for a minimum of five years following
implementation. Monitoring should be done on an annual
basis with reports submitted to the lead agency and DMG.
The monitoring program should address the stability and
success of the rehabilitated areas, compare these areas to
baseline conditions and performance standards, and suggest
remedial measures, where needed. The review of the reports
by agency personnel should allow for modifications in
monitoring, rehabilitation, or revegetation.
5. CCR Section 3502 (b) (1) requires that the reclamation plan
include a description of the environmental setting of the
mined site. The submitted reclamation plan describes the
site as native grasses and oaks . A more thorough
# description of the biotic setting of the site is necessary
r for three reasons, 1) to document baseline conditions
(especially withregard to the quality of the rangeland) ,
2) to aid in development and evaluation of an appropriate
revegetation plan, and 3) to evaluate purported mining and
reclamation impacts on wildlife habitat.
6. CCR Section 3502 (b) (3) states that the designed steepness
and proposed treatment of the mined lands ' final slopes take
into consideration the physical properties of the material,
landscaping requirements, and other factors. "In all cases,
reclamation plans shall specify slope angles flatter than
