Mine <br /> Reclamation Program files were also reviewed. The following <br /> comments, prepared by James Pompy, Gail Newton, and Kit Custis, <br /> are offered to assist in your review of this project. <br /> The Surface Mining and .Reclamation Act of 1975 (SMARA) and the <br /> State Mining and Geology Board regulations for surface mining and <br /> reclamation practice (California Code of Regulations (CCR) <br /> [formerly California Administrative Code (CAC) ] Title 14 , <br /> Chapter 8 , Article 1, Section 3500 et seq. ) (copies enclosed) <br /> require that specific items be addressed or included in <br /> reclamation plans. The following mandatory items were not <br /> adequately addressed in the documents submitted; we recommend <br /> that the reclamation plan be supplemented to fully address these <br /> items. <br /> I. SMARA Section 2772 (e) requires that the reclamation plan <br /> :include a description of the affected lands that includes <br /> 1 the boundaries and size of such lands and the location of <br /> l all. utility facilities within or adjacent to the property. <br /> 1 The reclamation plan states that the excavation area will be <br /> 20 acres and the total area of disturbance 40 acres. The <br /> boundaries of the excavation area are not clearly delineated <br /> or adequately defined on the maps in Appendix F or G. The <br /> 40 acres that will be disturbed are not adequately located <br /> within the map of the entire holdings (Appendix C) . It is <br /> { also not clear whether or not this plan is addressing only <br /> I, the excavated 20 acres or the full 40 acres. The locations <br /> j of all the utilities that are within or adjacent to the <br /> property also need to be clearly depicted on the site maps. <br /> I <br /> I <br />
