w <br /> REVISED CONDITIONS OF APPROVAL <br /> PA-0600348 <br /> Chinchiolo <br /> Minor Subdivision Application No. PA-0600348 was approved by the San Joaquin County <br /> Community Development Department on April 28, 2008.: The effective date of approval is May 8, <br /> 2008. This tentative map approval will expire on May 8, 2011, which is three years from the effective <br /> date of approval, unless (1) all Conditions of Approval have been complied with and (2)a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved revised tentative map dated December 18, 2007. A fee is required to <br /> process the Certificate of Compliance Application. ( Development Title Section 9-890.4) <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Certificate of Compliance: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects,.dust or fumes. San Joaquin County has determined that such <br /> inconveniences or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 40 acres. (Development Title Section 9-6102) <br /> d. TREE PRESERVATION: Future development on the parcels shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance: . <br /> (1) The following note shall be recorded as a separate instrument with the Certificate of <br /> Compliance: <br /> A. The removal of a Native Oak Tree, Heritage Oak Tree, or Historical Tree shall require an <br /> approved Improvement Plan application. Replacement of any tree removed. under <br /> Development Title Section 9-1505.3 shall be as specified in Section 9-1505.4. <br /> (2) If the tree is to remain, development constraints shall be noted on the subdivision plans, <br /> consistent with Section 1505.5 of the Development Title. <br /> e.
