The <br /> Rainbow School is permitted under U-81-14 for 34 pre-school and kindergarten children. : <br /> This application is tentatively scheduled to be heard by the Planning Commission on <br /> August 5, 2010. The Community Development Department has reviewed Use Permit <br /> application No. PA-1000127 and will be recommending that the Planning Commission <br /> approve the application subject to the following conditions of approval: <br /> COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: Kevin Swanson, [209] 468- <br /> 9653) <br /> APPROVED USE: Condition of Approval No. 11 of Use Permit No. U-81-14 is revised as <br /> follows: <br /> 1. The permitted use shall not at any time develop into a nuisance, as herein defined. If, in <br /> the opinion of the Board of Adjustment, Planning Commission or Board of Supervisors, <br /> an Count Ordinance or State Law or regulations or conditions attached hereto are <br /> Y Y g <br /> - tieing violated-in-connection-with-the-operation-oMi"se, that-they-retain-the-power to_ <br /> irevoke or modify this permit. For the purposes of this use permit, as nuisance is defines <br /> as follows: <br /> i Nuisance is defined as anything resulting from unreasonable or unlawful <br /> practices or from neglect which is, or tends to be injurious to health, safety, <br /> or public welfare, or is unsightly or offensive to the senses so as to interfere <br /> with the comfortable enjoyment of life or property in the neighborhood area, <br /> as such neighborhood area is defined by the Planning Department, <br /> Commission or Board of Adjustment." <br /> 2. The attached Plot Plan is hereby made a permanent part of this approved use permit <br /> and shall be identified as "EXHIBIT A," and all construction, reconstruction, moving, <br /> remodeling or other structural alteration shall be made in conformity therewith. Any <br /> variation from said Plot Plan shall be first approved by the Planning Department, <br /> Commission or Board of Adjustments. <br /> 3. This use is granted under the condition that said permit not be transferred within a 90- <br /> day period after the date of approval. <br /> 4. This Use Permit shall expire at the end of one year after the date of approval if <br /> construction has not been commenced and/or diligently pursued to completion. In <br /> addition, this Use Permit shall be null and void if the use(s) permitted are abandoned or <br /> unused for one year. <br /> 5. A Development Plan showing compliance with all conditions approved by all applicable <br /> departments. <br /> 6. Use Permit to be reviewed by the Board of Supervisors in July, 1981 to determine if <br /> there are any objections or problems within the neighborhood. <br /> 7. Provide a 3,400 square foot minimum size outside play area with a 6 foot high fence. <br /> 8. Provide four employee parking spaces and paved off-street drop-off areas. <br /> 9.
