STATE OF CALIFORNIA—THE NATURAL RESOURCES AGENCY EDMUND G.BROWN,JR.,GOVERNOR
CENTRAL VALLEY FLOOD PROTECTION BOARD
3310 EI Camino Ave., Rm. 151LFcoOQP
SACRAMENTO,CA 95821
(916)574-0609 FAX: (916)574-0682
PERMITS: (916)574-2380 FAX:(916)574-0682
May 1, 2012
Ms. Mo Hatef
Senior Planner
San Joaquin County
Community Development Department
Development Services Division
1810 East Hazelton Avenue
Stockton, California 95205
Subject: Application Number PA-1200053 (SA) (Pre-Application),
Commodities and Wholesale Distribution Facility near Stockton Diverting Canal
Dear Ms. Hatef:
Thank you for submitting the above subject application to the Central Valley Flood Protection
Board (CVFPB) for review and comment. Upon our review, we have determined a portion of the
proposed distribution facility lies within the 100-year floodplain for Stockton Diverting Canal. We
have also determined the proposed storm retention basin and all appurtenant features will
require a CVFPB encroachment permit.
Specific compliance with sections of the California Code of Regulations, Title 23, Waters, for the
proposed water retention basin and drainage swale are noted below for your reference:
• The proposed retention basin location will need to comply with Section 137, Paragraph
(b), as follows:
o "Landside water retention basins must be located outside of the projected levee
section and a minimum distance of twenty-five (25) feet from the levee toe plus
any additional distance that may be determined to be required to control seepage."
• The proposed drainage Swale along the levee toe will need to comply with Section 120,
Paragraph (a)(23) as follows:
o "The areas adjacent to the levee must drain away from the levee toes for a
minimum distance of ten (10) feet."
• The proposed drainage swale along the levee toe will also need to comply with Section
122, Paragraph (a)(1) as follows:
o "All ditches must be located at least ten (10) feet from the levee toe."
