Upon our review, we have determined a portion of the <br /> proposed distribution facility lies within the 100-year floodplain for Stockton Diverting Canal. We <br /> have also determined the proposed storm retention basin and all appurtenant features will <br /> require a CVFPB encroachment permit. <br /> Specific compliance with sections of the California Code of Regulations, Title 23, Waters, for the <br /> proposed water retention basin and drainage swale are noted below for your reference: <br /> • The proposed retention basin location will need to comply with Section 137, Paragraph <br /> (b), as follows: <br /> o "Landside water retention basins must be located outside of the projected levee <br /> section and a minimum distance of twenty-five (25) feet from the levee toe plus <br /> any additional distance that may be determined to be required to control seepage." <br /> • The proposed drainage Swale along the levee toe will need to comply with Section 120, <br /> Paragraph (a)(23) as follows: <br /> o "The areas adjacent to the levee must drain away from the levee toes for a <br /> minimum distance of ten (10) feet." <br /> • The proposed drainage swale along the levee toe will also need to comply with Section <br /> 122, Paragraph (a)(1) as follows: <br /> o "All ditches must be located at least ten (10) feet from the levee toe." <br />
