The undersigned is responding on behalf of <br /> both County Departments. <br /> You requested the Board of Supervisors to reconsider their <br /> General Plan action of July 2, 1992, to expand the Morada area to <br /> cover the request of Jim Carroll for a zoning change. You base <br /> your request on an alleged notice deficiency and on "Apparent <br /> confusion on the part of the Board as to the official position of <br /> the current Morada MAC and the residents of Morada. " Legal notice <br /> was given including notice to Morada MAC. The Board of Supervisors <br /> understands the diverse factors concerning the land use of the <br /> Morada area. Notwithstanding the above, the law precludes the <br /> Board from reconsidering the General Plan after its adoption <br /> without going through the procedures for the adoption of a general <br /> plan or the amendment of a general plan. <br /> Your second resolution requested the Board suspend <br /> consideration of the Carroll Subdivision. The Subdivision Map Act <br /> does not permit the Board to unilaterally stop consideration of a <br /> subdivision without the consent of the owners. <br /> The third resolution of the Morada MAC is that the County <br /> Planning Division initiate a general plan amendment returning the <br /> subject property to the agricultural zone.
