Analysis <br /> Background <br /> A poultry ranch was established on the project site before 1961. On August 29, 1983, the Community <br /> Development Department approved Development Pian application No. DP-79-80 for an expansion to the poultry <br /> ranch.The site remained in use until approximately 1990. <br /> On February 18, 1993, the Planning Commission approved Site Approval application No. SA-92-0073 to re- <br /> establish a poultry farm within the existing structures for a maximum of 300,000 birds. Neighbors appealed the <br /> approval to the Board of Supervisors. On April 21, 1993,the Board of Supervisors denied the appeal and upheld <br /> the Planning Commission's approval of the project with the addition of a condition of approval requiring that the <br /> applicant provide information to an adjacent property owner related to the site's compliance with governmental <br /> regulations, upon reasonable request. The adjacent property owner cited in the condition owned the property to <br /> the west (APN: 207-090-07), which contained an ostrich farm. This property now contains an orchard and is <br /> under new ownership. <br /> Facility Operations <br /> The hours of operation will continue to be daily from 5:00 a.m. to 6:00 p.m. daily. The facility will aiso <br /> continue to operate with a maximum of fifty-two (52)employees. <br /> Williamson Act <br /> The project site is subject to Wiiiiamson Act contract No. WA-72-01-0097. The contract restricts <br /> development to uses that are compatible with the Williamson Act and Development Title Section 9-1805. <br /> "Compatible Use" as defined in the Williamson Act includes uses determined by the County to be <br /> compatible with the agricultural, recreational, or open-space use of land within the preserve and subject to <br /> contract. (GC Section 51201[el)_Or July-20, 1992 the Board of Supervisors adopted Ordinance 3697 finding <br /> that Anima! Raising — Small Animals is compatible with the Williamson Act. Additionally, pursuant to <br /> Government Code Section 51238.1, uses approved on contracted lands shall be consistent with the <br /> following three principles of compatibility: <br /> (1) The use will not significantly compromise the long-term productive agricultural capability of the <br /> subject contracted parcel or parcels or on other contracted lands in agricultural preserves. <br /> • This Principle of Compatibility can be made because the proposed use is for a poultry egg <br /> farm and is an agricultural use as defined in the Williamson Act. The use is an approved use <br /> on contracted lands pursuant to Development Title Section 9-1810.3. The proposed <br /> expansion will not impact the long-term productive- agricultural capability of other <br /> contracted lands in the agricultural preserves. <br /> (2) The use will not significantly displace or impair current or reasonably foreseeable agricultural <br /> operations on the subject contracted parcel or parcels or on other contracted lands in agricultural <br /> preserves. Uses that significantly displace agricultural operations on the subject contracted parcel <br /> or parcels may be deemed compatible if they relate directly to the production of commercial <br /> agricultural products on the subject contracted parcel or parcels or neighboring lands, including <br /> activities such as harvesting, processing, or shipping. <br /> San Joaquin County PA-1500200/Jenkins <br /> Community Development Page 3 <br />
