From time to time, City and Developer are individually referred to in <br /> this Document as a "Party," and are collectively referred to as the "Parties." <br /> NOW, THEREFORE, in consideration of the mutual covenants and promises contained <br /> herein and other considerations, the value and adequacy of which is hereby acknowledged, the <br /> Parties hereby agree as follows: <br /> ARTICLE 1. <br /> RECITALS <br /> 1.01 In 2013, Developer submitted a specific request to the City for Out of Agency <br /> Sanitary Sewer utility service for Blossom Industrial Park at the North West corner of Newton <br /> and Cherokee Roads. The specific request was to convey sanitary sewer discharge from the <br /> Blossom Industrial Park into the existing public system, System 9, at a point along Wilson Way. <br /> 1.02. The property is currently in the County of San Joaquin. The proposed subdivision <br /> for the Blossom Industrial Park is attached hereto as Exhibit 1�A" and incorporated herein by this <br /> reference and is comprised of 139 acres proposed to subdivided into thirteen (13) parcels ranging <br /> from 3.77 acres to 33.95 acres (the "Property"). The legal description for the Property is <br /> attached hereto as Exhibit"B" and incorporated herein by this reference. <br /> 1.03 The Blossom Industrial Park will be marketed to create the maximum job <br /> generation. The concept is to include both warehouse and manufacturing opportunities, with an <br /> emphasis on the manufacturing opportunities, and including out parcels for small business <br /> attraction. The Blossom Industrial Park shall comply with the City Council Policy 900-1 and <br /> Stockton Municipal Code Section 13.08 and LAFCo Policy and Procedure for approval of Out of <br />
