Board of Supervisors -2- <br /> ACCEPTANCE OF IMPROVEMENTS, <br /> SECURITIES AND GRANT OF <br /> EASEMENT FOR HILLSIDE GREENS <br /> The Subdivision improvements, in general, consist of a well , <br /> water distribution system, equipment installation at the <br /> Par Country Estates Well Site No. 2 , street lighting, and roadway <br /> improvements . The Subdivider, Daniel Schack, et al, arranged for <br /> construction to begin in 1986 . As the water system and other <br /> improvements were nearing completion in early 1988 , water quality <br /> tests on the Hillside Greens well indicated that excessive levels <br /> of nitrates were present . <br /> During 1988, the Subdivider submitted several incomplete <br /> proposals for water treatment systems; to correct the- nitrate <br /> problem. After approximately six months, it became apparent the <br /> Subdivider was either unable or unwilling to correct the water <br /> system deficiencies. In September of 1988, the Board of <br /> Supervisors authorized a demand to Developers . Insurance Company <br /> (DICO) , as Surety, for completion of the Subdivider' s obligations <br /> (B-88--1356) . Shortly thereafter, the Bank of America initiated <br /> foreclosure proceedings against the Subdivider. <br /> During 1989, DICO and Bank of America commissioned several <br /> studies and rehabilitative efforts, in an attempt to resolve the <br /> nitrate problem. These proved unsuccessful, and neither DICO nor <br /> Bank of America displayed a willingness to pursue the problem <br /> further. In April of 1990, County Counsel filed a lawsuit; but <br /> deferred service of the complaint to allow various Subdivision <br /> acquisition proposals (by new developers) to run their course . <br /> In late 1992 , a new development group (Par Green Partners) <br /> displayed a serious interest in acquiring the Subdivision and <br /> resolving the water quality problems . They submitted a formal <br /> well rehabilitation proposal for County review in March of 1993 . <br /> In early April, 1993 , County Counsel_ served its previously filed - <br /> rawsu�it '(against RICO, Bank of America, et al) , to meet statutory <br /> deadlines for service and protect the County' s legal interests. <br /> Par Green Partners formalized acquisition of the Hillside Greens <br /> Subdivision in late April of this year. Their contractor began <br /> rehabilitation work at the Hillside Greens well site in early <br /> May. The original Hillside Greens well was abandoned, after <br /> rehabilitation efforts failed, and a new well was drilled on the <br /> same lot . The new well meets State Title 22 water quality <br /> guidelines . All remaining Subdivision improvements have been <br /> completed. The Department of Public Works and Public Health <br /> Services - Environmental Health Division have determined that the <br /> work is complete .and ready for acceptance by the Board of <br /> Supervisors . <br />
