UP-87-12 OF DENNIS KULIK, ET AL <br /> (SUPERVISORIAL DISTRICT 4) <br /> ------------------------------------------------------------------ <br /> RECOMMENDATION: <br /> It is recommended that the Planning Commission: <br /> 1 . Approve the one-year time extension for approved Use Permit <br /> Application No. UP-87--12 ; and <br /> 2 . Adopt by reference the Negative Declaration approved for <br /> UP--87-12 on May 21 , 1987 . <br /> BACKGROUND: <br /> On May 21 , 1987 , the Planning Commission approved Use Permit <br /> Application No. UP-87-12 to permit retail gasoline sales in con- <br /> junction with an existing grocery store . Since the Use Permit <br /> was approved, the applicant has acted in a good faith manner to <br /> meet all of the Conditions of Approval listed in the staff <br /> report , but due to unforeseen circumstances, he will not be able <br /> to meet all of the conditions within the required 18-month period <br /> from the date of approval . <br /> Additionally, the findings made in support of the Use Permit are <br /> still applicable at this time, as there have been no changes in <br /> circumstances that would result in the inability to make any of <br /> the findings for a Use Permit . Attached are the Findings made <br /> for UP--87-12 in the original staff report . <br /> If this Time Extension is granted, Section 9-1112 . 5 of the <br /> Planning Title specifies that the project must be totally <br /> completed within the extension period, which in this case is one <br /> year. <br /> CD/KS/blm <br /> Attachments <br />
