Business Loop 205, Tracy, CA <br /> (County site code 1393) <br /> To Whom It May Concern: <br /> In response to your letter dated March 3rd, 1992, enclosed is a workplan for additional <br /> investigation at the referenced site and a monitoring well permit application with the appropriate <br /> fee. <br /> The February 14th meeting regarding the status of the site was helpful in approaching a <br /> consensus as to the scope of work, necessary to satisfy the County that no threat to groundwater <br /> exists at the site. The letter of March 3rd was, for the inost_part, accurate in summarizing the <br /> concerns of WSP and RESNA. Some expansion is appropriate, however. <br /> As stated during :the meeting, the general position,of WSP and RESNA is that, in the event of <br /> an unauthorized leak, it is the duty of the responsible party to determine if groundwater quality <br /> has been adversely affected or;if a threat to groundwater quality exists. If water quality has not <br /> been affected and no threat exists the.obligations of the responsible party under the law have <br /> been met. We contend that repeated groundwater sampling has satisfactorily demonstrated that <br /> groundwater has not been adversely impacted at the site. As to the possibility of a threat posed <br /> by contaminated soil, we feel the evidence. indicates that the nature and concentrations of <br /> constituents present no significant threat to water quality. The lack of observable groundwater <br /> impact during the period of investigation confirms this assertion. We feel that investigation to <br /> date has been as thorough as necessary,.given the site conditions, and that closure is appropriate <br /> at this time. <br /> L-030792.6PS <br />
