Explanation of Request
My parents, Ira E. and Mico J. McAtee, purchased the property at
11733 N. Davis Road in March of 1974. At this time, the property was
zoned GA-5 with 100f t. f rontage road minimum. The General Pian was
changed in the 1980's which made the zoning for this area AG-40 with
330f t. frontage road minimum. The purpose of-this change was to
preserve the farmland in this area. Because my fathers land was not
farmland, nor was it forty acres, he was under the impression that the
change did not pertain to his property as it was GA-5 when he
purchased it. It has always been his intent to will 5 acres each to my
sister and I.
At this time, I am attempting to clear his estate as he and my
mother are 76 and 75 years old, respectively. My father is in poor
health and has had three recent surgeries for colon cancer. He walks
+. with two canes only short distances and has also recently been
k diagnosed with adult onset diabetes. He is a'naval aviator from WWII
and his medical care is in Livermore. I am a critical care nurse, very
capable and willing to care for him. Rather than wait for his demise, I
h
f am attempting to settle these issues now so I can build,a home
adjacent to my parents and care for them. The GA-5 is the zoning that
this property was represented to my parents as, and a large part of the
reason why they purchased it, having my sister and I in mind.
The granting of this.variance would serve to comply with the terms
of which my parents purchased the property and would make this
property more consistent with others in the area. It would improve the
aesthetics of the area as I am better able to care for the land than my
parents. It would increase the revenue for the county with the added
i taxes and fees I would pay and would decrease the medical costs to the
Veterans Administration for medical care I can provide to my father
free of charge. Most importantly, it will significantly increase the
t quality of my parents lives, for their remaining years (God - willing,
hopefully a few).
