Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> This finding can be made because the Initial Study prepared for the project found- no <br /> potentially significant environmental impacts. <br /> 5. The use is compatible with adjoining land uses. <br /> This finding can be made because the proposed use will not interfere with nor alter the <br /> current land uses on adjacent properties. The properties surrounding the project site are <br /> zoned AG-40 and are being used for agricultural purposes. <br /> Williamson Act Compatibilily Principles <br /> 1. The use will not significantly compromise the long-term productive agricultural capability of the <br /> subject contracted parcel or parcels or on other contracted lands in agricultural preserves. <br /> • This finding can be made because the Off-Site Wine Cellar is accessory to a <br /> vineyard; the project involves only 4.00 acres of an approximately 31 acre parcel; <br /> and the Off-Site Wine Cellar and associated marketing events promote agricultural <br /> products (wine) and encourage the production of more vineyards. <br /> I <br /> 2. The use will not significantly displace or impair current or reasonably foreseeable agricultural <br /> operations onfthe subject contracted parcel or parcels or on other contracted lands in agricultural <br /> preserves. Uses that significantly displace agricultural operations on the subject contracted parcel <br /> or parcels may be deemed compatible if they relate directly to the production of commercial <br /> agricultural products on the subject contracted parcel or parcels or neighboring lands, including <br /> activities such as harvesting, processing, or shipping. <br /> This finding can be made because the use, including parking areas,will occur <br /> mostly on property that is not farmed or likely to be farmed in the reasonably <br /> foreseeable future. Only about 24 parking spaces (4,320 square feet)will displace <br /> reasonably foreseeable agricultural operations. In any case,the proposed wine <br /> cellar and marketing events relate directly to the production of commercial <br /> agricultural products because they are for the storage and promotion of the wine <br /> produced by the vineyards grown on the property. <br /> 3. The use will not result in the significant removal of adjacent contracted land from agricultural or <br /> open-space use. In evaluating compatibility a board or council shall consider the impacts on <br /> noncontracted lands in the agricultural preserve or preserves. <br /> • This finding can be made because the proposed use,Winery and Wine Cellars,Wine <br /> Cellar, Off-Site,will encourage continued and expanded agricultural uses in the area. <br /> Therefore it will not result in the significant removal of adjacent contracted land from <br /> agricultural or open-space use. <br /> San Joaquin County= PA-08002031Panella <br /> Community Development Page 6 <br />
