Analysis <br /> Background <br /> On:June 3, 1993, the Planning Commission approved Major Subdivision Application No. SU-93-3. The <br /> approval was for a twenty-four (24) lot single-family residential subdivision. On December 17, 1996, the <br /> Board of Supervisors adopted Resolution R-96-834, approving the Subdivision Agreement (A-96-925) and <br /> the Final Map of Tract 2616, Ligurian Village Subdivision. This agreement required the applicant to <br /> construct improvements enumerated in the Conditions of Approval approved by the Planning Commission <br /> within a one(1)year period or within two(2)years from the date the Final Map was filed for record. <br /> To date, the applicant has not constructed any of the required improvements nor sold any of the lots. On <br /> February 12, 2002, the Board of Supervisors adopted Resolution R-02-88, approving initiation of <br /> proceedings for reversion to acreage of the Final Map known as Ligurian Village Subdivision. <br /> General Plan/Zoning <br /> The site is designated RIL (Residential-Low Density) and zoned R-L (Residential-Low Density). These <br /> designations will not change as a result of the reversion to acreage. <br /> Findings <br /> In order for the Board of Supervisors to approve the Reversion to Acreage application, it is mandatory that <br /> the first of the following four(4)findings be made and that at least one(1)of the remaining three (3)findings <br /> be made pursuant to Development Title Section 9-869.4: <br /> 3 <br /> 1. Dedications or offers of dedication to be vacated or abandoned by the reversion to acreage are <br /> unnecessary for present or prospective public purposes, based upon the policies and designations in . <br /> the General Pian. <br /> 2. All owners of an interest in the real property within the subdivision have consented to reversign; or <br /> 3. None of the improvements required to be made have been made within two(2) years from the date the <br /> final or parcel map was filed for record, or within the time allowed by agreement for completion of the <br /> improvements, whichever is the later,or <br /> 4. No lots shown on the final map or parcel map have been sold within five (5) years from the date such <br /> map was filed for record. <br /> Findings 1, 3, and 4 can be made. Finding 2 cannot be made because the owner has not consented to the I <br /> reversion.
