Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; <br /> 2. Forward Reversion to Acreage Application No. PA-02-99 to the Board of Supervisors with a <br /> recommendation of approval with the Findings and Conditions of Approval contained in the <br /> staff report. <br /> Findings <br /> 1. Dedications or offers of dedications to be vacated or abandoned by the reversion to acreage are <br /> unnecessary for present or prospective public purposes, based upon the policies and designations in <br /> the General Pian. <br /> This finding is mandatory in order to approve a Reversion to Acreage application. This <br /> finding can be made because, since none of the improvements for the subdivision have <br /> been built,the dedications or offers of dedications are unnecessary. <br /> 2. All owners of an interest in the real property within the subdivision have consented to reversion. <br /> • This finding cannot be made because the owner of the real property has not consented to 1 <br /> the reversion. <br /> 3. None of the improvements required to be made have been made within two (2) years from the date the <br /> final or parcel map was filed for record, or within the time allowed by agreement for completion of the <br /> improvements, whichever is later. <br /> This finding can be made because the final map was approved by the Board of Supervisors <br /> on December 17, 1996, and the necessary improvements have not been completed. The <br /> Subdivision Agreement stated that the applicants had one (1)year from the date of approval <br /> from the Board of Supervisors of the final map to complete the necessary improvements. <br /> The required improvements were not made within either of the permitted time frames. <br /> 4. No lots shown on the final map or parcel map have been sold within five (5) years from the date such <br /> map was filed for record. <br /> This finding can be made because the final map was approved by the Board of Supervisors <br /> on December 17,1996,and since then, none of the lots have been sold. <br /> San Joaquin County PA-02-991Vasti <br /> Community Development Page 4 <br />
