If construction is going to occur during the period of March 1 through <br /> September 15, a survey of the site should be conducted to disclose the <br /> presence of any active Swainson's hawk nest sites. If an active nest is <br /> located on or adjacent to the project site, the project applicant should be <br /> required to avoid disturbance to the site based on measures contained in <br /> DFG's Staff Report regarding mitigation for Impacts to Swainson's Hawks <br /> in the Central Valley of California. <br /> I <br /> i <br /> If these recommendations are not incorporated into the project design and final <br /> project conditions, we recommend that a draft Environmental Impact Report be <br /> prepared for the project. <br /> This project will have an impact to fish and/or wildlife habitat. Assessment of <br /> fees under Public Resources Code Section 21089 and as defined by Fish and Game <br /> Code Section 711.4 is necessary. Fees are payable by the project applicant upon filing <br /> of the Notice of Determination by the lead agency. <br /> Pursuant to Public Resources Code Section 21092 and 21092.2, the DFG <br /> requests written notification of proposed actions and pending decisions regarding this <br /> project.
