The parcel is currently used for a <br /> private stable and there is an existing single family residence and caretaker's residence on the property. <br /> The proposed project area is currently unplanted and contains 34,148 square feet of existing structures to <br /> be utilized for the commercial stable and irrigated pasture for horses. <br /> The Department of Conservation submitted a comment letter dated March 9, 2018 stating that the <br /> Department has concerns regarding the compatibility of some of the existing and proposed uses on <br /> Williamson Act contracted land. The Department offers its advice and guidance in its Equine Industry <br /> Policy paper. The Policy states that it, "...does not allow commercial or non-commercial boarding or riding <br /> facilities, stables, equestrian centers, show arenas or event center, or other similar facilities or operations <br /> that are not exactly equivalent to the breeding and training operations to be considered an "agricultural <br /> use" as described in the rest of the policy document." "Nor does the policy allow the keeping, boarding, <br /> training, or other use of horses — or any other animal — to constitute an agricultural use for purposes of <br /> the Williamson Act." <br /> The Department strongly recommends that the County place the property into nonrenewal and wait for <br /> the contract to terminate through the nonrenewal process before approving the proposed project. <br /> However, if the landowner wishes to pursue the proposed use before such time, the Department states <br /> that they should file for cancellation of the contract. Cancellation, if approved, would eliminate any <br /> conflicts with the Williamson Act. <br /> SJ Valley Air Pollution Control District <br /> The San Joaquin Air Pollution Control District submitted a comment letter dated February 12, 2018 <br /> stating that the Project is not expected to exceed any of the District's significant thresholds and therefore <br /> will have a less than significant impact on air quality. However, because the project will exceed 2,000 <br /> square feet of commercial space, the project is subject to District Rule 9510 (Indirect Source Review) and <br /> the applicant is required to submit an Air Impact Assessment (AIA) no later than applying for final <br /> discretionary approval. The project may also be subject to District Rules and Regulations, including <br /> Regulation VIII (Fugitive PM10 Prohibitions), Rule 4102 (Nuisance), Rule 4601 (Architectural Coatings), <br /> and Rule 4641 (Cutback, Slow Cure, and Emulsified Asphalt, Paving and Maintenance Operations). <br /> Department of Conservation <br /> This parcel is subject to Farmland Security Contract No. FA-99-0073. The contract restricts development <br /> to uses that are compatible with the Williamson Act and Development Title Section 9-1805. "Compatible <br /> use" as defined in the Williamson Act includes uses determined by the County to be compatible with the <br /> agricultural, recreational, or open-space use of land within the preserve and subject to contract. <br /> (Government Code Section 51201[e]) A commercial stable is a compatible use with property under <br /> contract pursuant to Development Title Section 9-1810.3(b)(1)(X).
