AWW *0 Section 9-881.3 of the County Development Title requires that applications for Time Extensions be reviewed and acted upon by the Review Authority that approved the original development application. In this case, the Review Authority was the Board of Supervisors; therefore the Time Extension application is being taken directly to the Board of Supervisors. REASON FOR RECOMMENDATION: Mr. Guerrero states the time extension is needed for the following reasons: "Financial constraints along with the need to secure all appropriate approvals from State and Federal agencies, such as the State of California Regional Quality Control Board, and the USDA. The additional time will allow us to comply with all of the requirements and conditions of the Use Permit." The Community Development Department received a few telephone calls from neighbors in opposition and one letter(with six photos) in opposition from Ann and Jerry Freitas, enclosed. Neighbors have voiced concern regarding the Use Permit's Conditions of Approval. Section 8-881.3(c.) of the County Development Title states that a Time Extension request may be granted by the Review Authority for a period not to exceed one (1) year. These provisions do not permit requests for modification of the Use Permit's Conditions of Approval by opponents. The applicant may request modification of the Use P'ermit's Conditions of Approval under Sections 9-878; "Revisions of Approval Actions" provisions of the County Development Title. The application is consistent with the General Plan and Board Order B-00-437, pertaining to General Plan Review, adopted April 11, 2000. A legal ad for the public hearing was published in the Stockton Record on February 2, 2001, and 20 public hearing notices were mailed on January 29, 2001. FISCAL IMPACT: None.
