UP-92-29: MID VALLEY AG SERVICE <br /> Thank you for allowing Regional Board staff to comment on the proposed <br /> construction of a retail fertilizer outlet on Escalon--Bellota Road in Escalon. <br /> We have three comments relating to this proposal . <br /> As you know, the Board has adopted a Waiver of Waste Discharge Requirements <br /> for retail fertilizer dealers (copy enclosed) . We would expect this facility <br /> to be constructed and operated in such a manner as to meet the items listed in <br /> the waiver. <br /> We are concerned that the pond not impact water quality. State regulations <br /> require that the bottom of the pond be at least five feet above the highest <br /> anticipated level of ground water. In addition, the proponent's engineer <br /> should demonstrate that the pond is lined to a degree that prevents pollutants <br /> from reaching ground water. <br /> Finally, we are concerned about the degree of flood protection afforded a <br /> facility next to Lone Tree Creek. What is the current flood zone designation <br /> for this area? Is this appropriate, or should the facility, be constructed in <br /> some manner that affords it extra flood protection? <br /> Please keep me informed as to the progress of this application.
