PHASE I <br /> ENVIRONMENTAL SITE ASSESSMENT REPORT <br /> NEIGHBORHOOD G <br /> 20001 & 20043 MOUNTAIN HOUSE PARKWAY <br /> AND SOUTH OF BYRON AND <br /> WEST OF MOUNTAIN HOUSE PARKWAY <br /> PORTIONS OF ASSESSOR'S PARCELS <br /> 209-050-06,209-050-02,209-040-12,AND 209-040-13 <br /> TRACY,SAN JOAQUIN COUNTY <br /> CALIFORNIA <br /> EXECUTIVE SUMMARY <br /> October 29,2001 <br /> This ASTM Phase I Environmental Site Assessment was performed by Condor Earth Technologies, Inc. <br /> (Condor) in August 2001 at the request of Mr. Eric Teed-Bose of Trimark Communities, Inc. (Client), <br /> Tracy, California. The assessment was performed for a portion of the properties (Site) designated by <br /> Assessor's Parcel Numbers (APN) 209-050-06 and 209-050-02 located at 20001 and 20043 Mountain <br /> House Parkway (formerly Patterson Pass Road), and APN 209-040-12 and 209-040-13 located south of <br /> Byron Road and west of Mountain House Parkway (respectively), in Tracy, California. The Site consists <br /> of approximately 240 acres and is being considered by the Client for a residential development. <br /> ' This report consists of a Phase I Environmental Site Assessment(ESA) performed in accordance with the <br /> guidelines set forth in Practice E 1527-00, Standard Practice for Environmental Site Assessments: Phase I <br /> Environmental Site Assessment Process, published in May 1993 (Revised 2000) by the American Society <br /> for Testing and Materials (ASTM) and in accordance with the prevailing standard of care for completing <br /> such assessments in California at this time. The purpose of the ASTM Phase I ESA is to conduct an <br /> appropriate inquiry into the previous ownership and uses of the property to help in partially satisfying the <br /> innocent landowner defense to Comprehensive Environmental Response, Compensation and Liability <br /> Act (CERCLA) liability and to identify "potential environmental conditions that could materially impact <br /> the operation of the business associated with the parcel of commercial real estate" (ASTM Standard <br /> Practice E 1527-00, Section 5.5). <br /> FINDINGS <br /> The Site is currently used for agricultural purposes. Reconnaissance revealed no suspect environmental <br /> conditions at the Site or any nearby properties. The review of ASTM-specified environmental records <br /> identified one location within the specified search radii. Trimark Communities, located about 1,600 feet <br /> to the northeast of the Site, was identified by the Hazardous Waste Information System (HAZNET) <br /> database. Review of San Joaquin County Public Health Services/Environmental Health Division (PHS- <br /> EHD) and San Joaquin County Office of Emergency Services (OES) records produced no further <br /> information regarding the location. Additionally, there are no records on file with PHS-EHD or OES for <br /> the Site or any other adjoining properties. Pesticide Use Reports provided by the San Joaquin County <br /> Agricultural Commissioner's Office revealed that pesticides have been used on the Site for the last five <br /> years. An interview with the site manager also indicated the use of pesticides for agricultural purposes at <br /> the Site. <br /> 1.
