Records that are sorted, filed, organized, <br /> or maintained by the source agency only chronologically are not generally practically reviewable. <br /> Listings in publicly available records, which do not have to be located geographically, are not generally <br /> practically reviewable. For large databases with numerous facility records (such as RCRA hazardous <br /> waste generators and registered under ground storage tanks), the records are not practically reviewable <br /> unless they can be obtained from the source agency in the smaller geographic area of zip codes. Even <br /> when information is provided by zip code for sane large databases, it is common for an unmanageable <br /> number of sites to be identified within a given zip code. In these cases, it is not necessary to review the <br /> impact of all the sites that are likely to be listed in any given zip code; that information would not be <br /> practically reviewable. In other words,when so much data is generated that it cannot be feasibly reviewed <br /> for its impact on the property, it is not practically reviewable. <br /> ASTM 3.3.29 Publicly available — Information that is publicly available means that the source of the <br /> information allows access to the information by anyone upon request. <br /> ASTM 3.3.30 Reasonably ascertainable — For purposes of both this practice and Practice E 1528, <br /> information that is (1)publicly available, (2) obtainable from its source within reasonable time and cost <br /> constraints, and(3)practically reviewable. <br /> ASTM 3.3.43 Visually and/or physically observed— During a Site visit pursuant to Practice E 1528, or <br /> pursuant to this practice, this term means observations made by vision while walking through a property <br /> and the structures located on it and observations made by the sense of smell, particularly observations of <br /> noxious or foul odors. The term "walking through" is not meant to imply that disabled persons who <br /> cannot physically walk may not conduct a Site visit; they may do so by the means at their disposal for <br /> moving through the property and the structures located on it. <br /> 1.4 LIMITATIONS AND EXCEPTIONS <br /> Condor performed this environmental assessment in accordance with the guidelines set forth in the ASTM <br /> E 1527-00 Standard Practice for Environmental Site Assessments: Phase I Environmental Site <br /> Assessment Process. This ASTM Phase I ESA is thorough, but it is not intended to identify all potential <br /> concerns or to eliminate all risk of the subject property(ies) bearing some degree of environmental <br /> liability. Condor cannot, and will not, warrant or certify that the Site is free of contaminants because it is <br /> impossible to know if such a condition exists. Although risks can never be eliminated, more detailed and <br /> extensive investigations yield more information. This information may help you better manage your risks. <br /> Such detailed services involve greater expense. We ask our clients to participate in identifying the level of <br /> service that will provide them with an acceptable level of risk. Please contact Condor personnel <br /> responsible for this report if you would like to discuss this risk issue in greater detail. <br /> The scope of this project was presented in our contract addendum and contract number 2496U, dated July <br /> 16, 2001, and subsequently approved by the Client on July 19, 2001. The scope of work for this report is <br /> intended to provide an appropriate inquiry into the previous ownership and uses of the property to help in <br /> partially satisfying the innocent landowner defense to CERCLA liability and to identify "potential <br /> environmental conditions that could materially impact the operation of the business associated with the <br /> parcel of commercial real estate" (ASTM Standard Practice E 1527-00, Section 5.5). The scope of work <br /> for this project was limited to a qualitative evaluation of environmental concerns associated with the <br /> potential presence of hazardous materials in conjunction with current and previous activities on the Site <br /> and did not include other services that are not described in this report. Specifically excluded from the <br /> scope of work are (1)the evaluation of the Site for the presence of asbestos, radon, and lead-based paint, <br /> (2) a survey of the Site for wetlands or rare and endangered species, (3) a survey of the Site for historical <br /> or cultural resources, and(4)research into the title history of the Site. <br /> w <br /> i, CONDOR <br />
