Phase 1 Environmental Site Assessment <br /> Neighborhood G <br /> Page 5 <br /> Condor has completed the ASTM Phase I ESA, as an environmental professional, in accordance with the <br /> ASTM guidelines and with the customary state of the practice and the prevailing standard of care for <br /> completing such assessments in California at this time. Condor shall not be subject to any express or <br /> implied warranties whatsoever. <br /> The property owner is solely responsible for notifying all governmental agencies and the public at large of <br /> the existence, release, treatment, or disposal of any hazardous materials observed at the Site, either before <br /> or during performance of Condor's services. Condor assumes no responsibility or liability whatsoever for <br /> any claim, loss of property value, damage, or injury which results from pre-existing hazardous materials <br /> being encountered or present on the Site, or from the discovery of such hazardous materials. <br /> This report and other instruments or service are prepared and made available for the sole use of the <br /> officers and representatives of the Client. The contents thereof may not be used or relied upon by any <br /> other person(s)without the express written consent and authorization of the Client. <br /> 1.5 SPECIAL TERMS AND CONDITIONS <br /> None noted. <br /> 1.6 USER RELIANCE <br /> Land use, Site conditions (both on-Site and off-Site), and other factors will change over time. Site <br /> activities and regulations beyond our control could change at any time after the completion of this report. <br /> Our observations, findings, and opinions can be considered valid only as of the dates of the Site visits. <br /> ` This report should not be relied upon after 180 days from the date of issuance (ASTM Standard E-1527- <br /> 00, Section 4.6). <br /> 2.0 SITE DESCRIPTION <br /> 2.1 LOCATION AND LEGAL DESCRIPTION <br /> The Site is shown on the Clifton Court Forebay, California, United States Geological Survey(USGS) 7.5- <br /> Minute Topographic Map, dated 1978. The Site consists of approximately 240 acres and comprises <br /> portions of Sections 4, 5, 8, and 9, Township 2 South, Range 4 East, Mount Diablo Base and Meridian. <br /> The Site parcels are included in San Joaquin County Assessor's Parcel Map Book 209 on page 50 <br /> (Parcels 6 and 2) and page 40 (Parcels 12 and 13). The Site street addresses are 20001 and 20043 <br /> Mountain House Parkway, for APN 209-050-06 and 209-050-02, respectively. The properties designated <br /> by APN 209-040-12 and 209-040-13 have no street addresses assigned and are located south of Byron <br /> Road and west of Mountain House Parkway, in Tracy, California. The Site is shown on Figures 1, 2, and <br /> 3 in Appendix A. The legal description from the Preliminary Title Report is contained in Appendix F. It <br /> must be noted that this Site will be a part of a legally new town, Mountain House, California, and that the <br /> real properties indicated in this report have been listed as real properties in Tracy, California. <br /> 2.2 SITE AND VICINITY GENERAL CHARACTERISTICS <br /> The Site is located within the proposed Mountain House community development, northwest of the city <br /> of Tracy, west of Mountain House Parkway, north of Grant Line Road, and south of Byron Road (Figures <br /> I and 2, Appendix A). Interstate 205 is located approximately two miles south of the Site. The Site is on <br /> rural agricultural property. The adjacent properties are used for irrigated agricultural crops with a few <br /> farm residences and fallow fields in the area. The USGS map shows that the terrain of the Site is nearly <br /> level with a slight slope to the northeast. <br /> w <br /> i, CONDOR <br />
