By:landowners participating in 66 program, parcels are assessed for property.tax <br /> purposes.at a rate consistent with'their actual use; rather than their potential market value. The'rminimum <br /> term for, contract is 40 years and the contract'automatically renews itself each`yea runless a"Notice of <br /> Nonrenewal" is filed which tentatively begin the,terrimination process. The County_s.participatton'in,the <br /> Williamson Act program to'i <br /> dates back '969. As.of January 2007, the.County had 542;582.06 acres <br /> under Williamson Act Contracts. <br /> On December 26, 1972, California Land Conservation Contract No. 73-C1-65 was initiated for Assessor's <br /> Parcel Numbers 063-110-.15 and.063-2110-14. The Community Development Depart.ment,appr'" '&d a Notice. <br /> of Nonrenewal for a portion of contract No. 73-C1-65 6ontaining-11.24 acres on July.5, 2007. The applicant is <br /> proposing to cancel 1.44 acres of contract'No. 73-C1-65.The purpose of'the cancellation is to create a1.44 <br /> acre homesite for an agricultural worker by adjusting the line with the parcel to the north (APN: 063-110-33). <br /> The resultant parcels would contain.17.0.95 acres and 1.44 acres. The proposed 1.44-acre parcel will contain <br /> an existing residence and agricultural.building. <br /> The eastern property line of the parcel abuts North State Route Highway 88. The northern property line <br /> abuts East Bay Municipal Utility District Mokelumne Aqueduct. The southern property line is adjacent to <br /> agricultural lands <br /> Contract Cancellation Findings <br /> The Board of Supervisors may grant tentative approval for cancellation of a contract on Williamson Act <br /> property only if it makes one of the following findings: <br /> 1. That the cancellation is consistent with the purposes of the Williamson Act-, or <br /> 2. That the cancellation is in the public interest. <br /> Both of these findings include subfindings that the Board must also make. The applicant is requesting <br /> that the cancellation be granted based upon the ability to make Finding No. 1. The following is an <br /> analysis of Finding No. 1. <br /> 1. That the cancellation is consistent with the purposes of the Williamson Act. <br /> a. The cancellation is for land on which a Notice of Nonrenewal has been served pursuant to <br /> Section 51245 of the Government Code. <br /> This subfinding can be made because the Community Development Department <br /> approved a Notice of Nonrenewal on July 5, 2007. <br /> b.
