The cancellation is for.an alternative use which is consistent with the applicable provisions of <br /> the County General Plan. <br /> This subfinding can be.made because a single-fancily,residence.and.an.agricultural' <br /> building are.permitted'uses in the'AG-40 zone and are consistent with the'Al (General , <br /> Agriculture)'-General Plan Designation. <br /> d: 'The cancellation will not result in discontiguous patterns of urban development. <br /> This subfinding can be made because this cancellation will not result in,or encourage, <br /> urban development. <br /> e, There is no proximate noncontracted land which is both available and suitable for the use <br /> which is proposed the contracted land be put, or, development of the contracted land would <br /> provide more contiguous patterns of urban development than development of proximate non- <br /> contracted land. <br /> This subfinding can be made because a residence and agricultural building exist on <br /> the parcel and are on property under contract. <br /> Department of Conservation and Notification <br /> Pursuant to Government Code Section 51284.1, the county must submit a notice to the Department of <br /> Conservation and consider its comments prior to approving a tentative Williamson Act contract <br /> cancellation. The notice must include a copy of the application, a copy of the contract, a description of the <br /> land, and a deadline for submitting comments. Such notice was mailed to the Department of <br /> Conservation on December 21, 2007. <br /> Cancellation Value and Cancellation Fees <br /> The County Assessor is responsible for computing a cancellation fee for the subject property based on 12 <br /> '/z percent of the current market value. Prior to giving tentative approval to the cancellation of any <br /> contract, the Board must certify to the County Auditor the amount of the cancellation.
