APPEAL OF STAFF ACTION <br /> SAN JOAQUIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT <br /> BASIS FOR APPEAL <br /> GEOGRAPHICAL OVERVIEW <br /> The proposed land division was denied on the assumption that more than six par- <br /> cels are currently using the private road. This is only true for the first 300± <br /> feet of this road, the section that connects to State Highway Route 88. At the <br /> 300±-foot point the road separates into two private roads. The southerly road <br /> currently serves three parcels. The proposed project will add one additional <br /> parcel to the southerly roadway for a total of four parcels. Therefore, neither <br /> the northerly roadway nor the southerly roadway will excess the six-parcel max- <br /> imum limitation. <br /> The existing southerly roact is a well maintained oiled road. It is important to <br /> all the adjoining property owners to maintain a dust-free road in order to pro- <br /> tect the vineyard from the problems of dust. The existing road is safe and pro- <br /> vices at least a 25-foot clearance for emergency vehicle access. <br /> Access to the proposed building site will be via an existing roadway, through the <br /> vineyard, from said southerly road. <br /> SUGGESTED RECONSTRUCTION <br /> The suggestion to construct: and dedicate a 50-foot road to the County is neither <br /> in the best interest of the public or the property owners in this area for the <br /> following reasons: <br /> 1 . The southerly road dead-ends to the Mokelumne River. Therefore, there is no <br /> possibility to extend it to any County road. <br /> 2. To open this area with a public road invites the public with illegal access to <br /> the river with the ensuing problems of vandalism, litter, possible litigation <br /> for injury, and the added responsibility placed on the Sheriff' s Department. <br /> 3. The owners would lose control of their access and would see the deterioration <br /> of their secluded environment. <br /> 4. Currently the owners know which cars belong in the area and which do not. <br /> With a public road this type of neighborhood watch would not be as effective. <br /> CONCLUSION <br /> There are no benefits or enrichments, either public or private, that could possibly <br /> result from the reconstruction and dedication of the existing road or any part <br /> thereof. <br /> The County recently allowed the users of the northerly road additional parcels on <br /> the first 300± feet without the construction of a public road. We are requesting <br /> the same privilege. <br />
