APR 2006 <br /> 1810 E.Hazelton Ave. CommonitY peVeloPment Dept. <br /> Stockton,CA 65205 <br /> ATTN: SJC Planning Commission <br /> RE: Initial Study PA-0600066,Quality Landscape, 17142 Fox Road,Lodi,CA;Contractor <br /> License#714914. <br /> To Whom It May Concern: <br /> On April 12,2006 I received the study from the SJC Community Development Staff regarding the above <br /> referenced business proposal.My opposition to this proposal was expressed in a March 12,2006 letter(see <br /> attached)to staff in which several concerns regarding this project were expressed. <br /> After reviewing the Initial Study by staff;I feel obligated to express the following objections to the <br /> inadequacies outlined in this study: <br /> #1. Water. The entire area is subject to flooding. Every winter except for a few drought years,the <br /> proposed site and the surrounding properties have been subject to flooding. Every year since <br /> installing the stop fight at Highway 12 and Highway 88 intersection,Cal Trans has pumped the <br /> storm pond at this location.A terminal out for the flood waters in this area is non existent. <br /> #5. Noise. Last summer workers from this business were using an unauthorized access to the property <br /> off of Highway 12. This use was causing a noise and dust problem for the surrounding residents. <br /> This unauthorized use was also creating a dangerous traffic condition that could have caused a <br /> serious traffic accident. <br /> #7. Hazards. Nursery and landscaping operations usually store fertilizer and pest control chemicals on <br /> site.Businesses are required to register with OES if they store any chemicals on site. This data base <br /> is secured through a business license and made available to the local fire jurisdiction. <br /> #9. Transportation/circulation. As a 33 year resident in this area,I have witnessed an extensive <br /> increase in traffic on Highway 12.This was a major concern of staff on another similar project <br /> proposed at 11849 E.Highway 12,Lockeford,CA(PA-0400608.This proposed project would <br /> have required a traffic study and a new site plan by staff.This project was pulled by the applicant. <br /> Surrounding land uses: East of this proposed project exists a commercial trucking operation. Three <br /> residential dwellings down from this proposal is another commercial truck operation.West of this proposed <br /> project are residential dwellings.North of the proposed project are residential dwellings and a contractors <br /> yard that has been cited for a zoning violation which has been referred to the SJC District Attorney for <br /> prosecution. <br /> The residents of this area are concerned about the growing number of businesses that are locating in areas <br /> that are not compatible with existing zoning laws.Your consideration in evaluating the negative issues <br /> associated with this proposal and reject this project would be appreciated. <br /> Sin //y, <br /> Ronald L.Val' oti <br />
